INSPECTION NO. 040-09043/99-001 AND NOTICE OF VIOLATION

Dear Dr. Irwin:

l On August 12,1999, Eric Rober of this office conducted a safety inspection at the above address of activities authorized by the above listed NRC license. The inspection was limited to a review of an event in which four natural uranium slugs could not be accounted for when uranium that was used in a sub-critical reactor assembly was prepared for shipment. The findings of the inspection were discussed by Mr. Rober and myself with you and Dr. James J. Grant at the conclusion of the inspection.

I Based on the results of this inspection, it appears that your activities were not conducted in full compliance with NRC requirements. A Notice of Violation is enclosed that categorizes each violation by severity level in accordance with the " General Statement of Policy and Procedure for i NRC Enforcement Actions, "(Enforcement Policy), NUREG 1800. The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence is already adequately addressed on the docket in your reports dated August 5,1999 and September 1,1999. Therofore, you are not required to respond to this letter unless the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice.
