U.S. NUCLEAR REGULATORY COMMISSION RESPONSE TO VOLUNTARY SELF DISCLOSURE LETTER DATED OCTOBER 7, 2019
Dear Ms. Guritza:
Thank you for your letter dated October 7, 2019 disclosing an alleged unauthorized export to the United Kingdom of 43.7 pounds of nuclear grade graphite by the University of Central Florida (UCF). Upon further review of the material provided by UCF in its self-disclosure, and in coordination the U.S. Nuclear Regulatory Commissions (NRC) Office of General Counsel, the NRC Office of International Programs has determined that no violation of NRC regulations occurred. The NRC does not have jurisdiction over exports by the U.S. Department of Energy (DOE) of items that qualify as material or components under Atomic Energy Act § 109b (e.g., nuclear grade graphite for nuclear end use). During its review, the NRC determined that the export of nuclear grade graphite was performed on behalf of DOE, based on a contractual relationship between DOE and UCF. Therefore, this particular export does not fall under NRC export licensing jurisdiction. The original determination provided by the NRC on September 27, 2017 did not consider that the UCF was performing work on behalf of DOE under an established contract.
