October 2019 Status Update for the Petitioner l PRM 171-1 Date: Friday, October 18, 2019 5:53:00 PM Mr. Meier, I am contacting you to provide a status update on a petition for rulemaking you submitted to the U.S. Nuclear Regulatory Commission (NRC), dated February 28, 2019. In your petition, you requested that the NRC amend Title 10 of the Code of Federal Regulations (10 CFR),

Section 10 CFR 171.15, Reactor Licenses and Independent Spent Fuel Storage Licenses, related to the start of assessment of annual fees for certain nuclear power plants to align with commencement of their commercial operation. The NRC docketed your letters as petition for rulemaking PRM-171-1, and the NRC published a notice of receipt in the Federal Register on June 10, 2019 (84 FR 26774).

The NRC continues to evaluate and address the resolution of the issues raised by PRM-171-1. Once the petition has been resolved, the NRC will publish a notice in the Federal Register explaining the NRCs finding. You will also receive a letter at that time notifying you of the action the NRC has taken. In the interim, the status of PRM-171-1 can be found at the NRC Rules and Petition page at https://www.nrc.gov/reading-rm/doccollections/rulemaking-ruleforum/active/PetitionIndex.html. At this Web site there is a link to a listing of all active NRC PRMs. You can monitor this site for status updates as they become available. You can also continue to monitor the docket for PRM-171-1 at http://www.regulations.gov.
