Dear Mr. Cuthbert:
This is in response to your April 22, 1988 letter in which you requested, pursuant to the "reedon of Information Act (FOIA), copies of the NRC's radioactive materials license issued to Honeywell Inc., Defense Systems Group, and any notices of violation that may hcve been issued the company for the years 1986, 1987, and 1988.
The documents identified on the enclosed Appendix A are already available in the NRC Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555. We have indicated the PDR Accession number beside each document description. The docurnents identified on the enclosed Appendix B are being placed in PDR file folder FOIA-88-240 in your name. We are enclosing a copy of a notice which provides charges and procedures for obtaining copies of records from the PDR.
The documents that are identified on the enclosed Appendix C are being withheld from public disclosure pursuant to Exemption (4) of the F0IA (5 U.S.C. 552(b)(4) and 10 CFR 9.17(a)(4) of the Commission's regulations.
We are consulting with the submitter to review the proprietary claim, and we will let you know as soon as possible if these records, or any portions thereof, may be disclosed to the public.
Pursuant to 10 CFR 9.25(b) of the NRC's regulations, it has been determined that the information withheld is exempt from production or di: closure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Hugh L.
Thompson, Jr., Director, Office of Nuclear Material Safety and Safeguards.
This denial may be appealed to the NRC's Executive Director for Operations I within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U. S. Nuclear Regulatory Connission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an "Appeal from an Initial F01A l Decision." l l
