If the licensee uses sealed sources or probes containing sealed sources at g y ' depths greater than 3 feet, the licensee shall use surface casing that extends g y from the lowest depth to 12 inches above the surface and other appropriate g g procedures to reduce the probability of the source or probe becoming lodged g g below the surface. , y ! If a sealed source or a probe containing sealed sources' becomes lodged below E , the surface and it becomes apparent that efforts to recover the sealed source l y or probe may not be successful, the licensee shall notify the U. S. Nuclear - Regulatory Commission and submit the report required by 10 CFR 30.50(b)(2) and l g l (c). The licensee shall not abandon the sealed source or probe without , g obtaining the Commissions's prior written consent. g 6 20. You will notice that we have updated your license to our current format to provide added flexibility in the acquisition of nuclear gauges. If you have any questions, you may contact Kent M. Prendergast at (510) 975-0255. NRC expects licensees to conduct their programs with meticulous attention to detail and a high standard of compliance. Because of the serious consequences to employees and the public which can result from failure to comply with NRC requirements, you must conduct your program involving radioactive materials in accordance with the conditions of your NRC license, representations made in your license application, and NRC regulations, in particular, note that you must: 1. Operate in accordance with NRC regulations 10 CFR Part 19, " Notices, instructions and Reports to Workers: Inspection and Investigations," 10 CFR Part 20, " Standards for Protection Against Radiation," and other applicable regulations. 2. Possess radioactive material only in the quantity and form indicated in your license. 3. Use radioactive material only for the purpose (s) indicated in your license. 4. Notify NRC in writing of any change in mailing address (no fee required if the location of radioactive material remains the same). 5. Request and obtain written NRC consent before transferring your license or any right thereunder, either voluntarily or involuntarily, directly or indirectly, through transfer of control of your license to any person or entity. A transfer of control of your license includes not only a total change of ownership, but also a change in the controlling interest in your company whether it is a corporation, partnership, or - other entity. In addition, appropriate license amendments must be requested and
j obtained for any other planned changes in your facility or program that are contrary l to your license or contrary to representations made in your license application, as l well as supplemental correspondence thereto, which are incorporated into your

' * Onsite areas, other than restricted areas, where spills or other unusual occurrences involving the spread of contamination in and around the facility, equipment, or site have occurred that required reporting pursuant to 10 CFR 30.50(b)(1) or (b)(4), including areas where subsequent cleanup procedures have removed the contamination. * Specific locations and radionuclide contents of previous and current burial areas within the site, excluding radioactive material with half-lives of 10 days or less, depleted uranium used only for shielding or as penetrators in unused munitions, or sealed sources authorized for use at temporary job sites. * Location and description of all contaminated equipment involved in licensed , operations that is to remain onsite after license termination. ) 1 7. Submit a complete renewal application with proper fee, or termination request at ) least 30 days before the expiration date on your license. You will receive a reminder notice approximately 90 days before the expiration date. Possession of radioactive material after your license expires is a violation of NRC regulations. * 8. Request termination of your license if you plan to permanently discontinue activities involving radioactive material. You will be periodically inspected by NRC. of the well' casing 12 inches above the surface and the means to ensure the well ' is clear of obstructions. I offered the suggestion that a dummy could be j lowered down the well prior to using the probe to ensure the well is free of 1 obstructions and that the well casing should be above ground to preclude the intrusion of soil or debris into to the well which may-hamper retrieving the . probe. We also discussed the range of the -rrvey meter they use and although the range was less than 100 millirem suggested in the DGOO8 that it'would probably be satisfactory for detection of contamination in the event of a loss of' source integrity. I offered that because we are not gesng completely renewing the application at this time that the licensee should check with other i sources such as DOT, Fire Departments, consultants, and etc., and determine the availability of other survey meters that me be available in an emergency. 1U.S. NUCIEAR REGULATORY COMMISSION , 1450 Maria Lane , . ; Walnut Creek,- California 94596-5369 l i Amendment to License Number 50-21238-01 l i Dear Mr. Prendergast: This letter requests the U.S. Nuclear Regulatory Commission (NRC) to amend Harding Lawson Asso- clates' (HLA's) nuclear material license (No. 50-21238-01) to incorporate the following CPN gauge: CPN Model 503 Hydroprobe Nuclide: Am-241/Be 50 MCI Form: Sealed Source (CPN Model CPN-131) Possession Limit: One Source HLA will use the CPN Model 503 hydroprobe to measure in situ soil moisture in cased wells (access tubes). The instrument will be used by lowering the source / detector down the access tube to the derired measurement depth. As we discussed on April 16,1997, HLA will lower a " dummy" probe to the bottom of the access tube immediately prior to each monitoring event as a means of ensuring that the access tube is free and clear of obstructions. The CPN Model 503 hydroprobe is configured with 40 feet of extension cable.- Therefore, the source / detector will be lowered to a maximum depth of 40 feet below the top of the access tube. The access tubes will be constructed of 2-inch schedule 40 steel pipe. The top of each access tube will be maintained to a minimum elevation of 12 inches above ground surface. The instrument will not be used in uncased wells. If the source fails to return to the shielded position, or if any other emergency situation arises, HLA will follow the emergency procedures specified in Appendix H to the NRC's Draft Regulatory Guide { DG-0008 dated May 1995. The following specific emergency procedures will be used to recover the .i sealed source in the event that the source becomes lodged or detached in an access tube: ] e Notify the NRC Emergency Operations Center at (301) 816-5100. ] . Extract the access tube from the ground using a hydraulic well puller. i e Cut the access tube in the proximity of the lodged or detached source using a pipe cutter. .! e. Dislodge and/or remove the scaled source. A Troxalert Radiation Monitor is maintained and stored at HLA's Anchorage office. HLA will main- tain the instrument by submitting it to the manufacturer for recalibration once per year. In case of an emergency, HLA will ship the Troxalert survey meter to the jobsite to perform radiation surveys. The ' Troxalert Radiation Monitor is capable of measuring radioactivity in the range of 0.06 to 50 millirem - per hour. Each instrument user will attend certification training from the instrument manufacturer, Boart Longyear/CPN. Mr. Douglas Carter, a Radiation Safety Officer with Boart Longyear/CPN, will provide the training in Anchorage, Alaska, on May 8 and 9,1997. The training will include 8 hours of nuclear . gauge certification training.and 8 hours of operation (instrument specific) training. HLA will forward , '
