Dear Mr. Graziano:

This is in response to your letter of February 14, 1985, in which you re-quested, pursuant to the Freedom of Information Act (FOIA), selected records regarding Request for Proposal (RFP) No. RS-01E-84-160 entitled " Technical Assistance in Reviewing the Work of the Licensee's Independent Design Verification Contractor for a Specific Nuclear Project."

The records you requested, as discussed specifically below and described on the enclosed appendix, are now available for public inspection and copying at the NRC Public Document Room (PDR) in PDR file F01A-85-112 under your name.

Regarding the records you requested under category one, the scores of your company's proposal and the successful proposal are being withheld pursuant to Exemption 5 of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Com-mission's regulations. This information is deleted because it represents predecisional information by the Source Evaluation Panel (SEP) for RFP-RS-0!E-84-160.

Regarding the records you requested under category two, we have only a record that contains the names and pertinent titles of the members of the SEP regarding this RFP.

In a telephone conversation between David Meyer and you on March 25, 1985, you agreed to accept a nonproprietary version of the successful proposal which you reouetted under category three of your February 14 letter.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for denial of the information are the undersigned and Edward L. Halman, Director, Division of Contracts.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

Enclosed also is a copy of a notice that explains the procedures and charges for obtaining records from the PDR.

In view of the NRC's response to your F0IA request and the fact that you have new appeal rights, no further action is being taken on your April 26, 1985, appeal letter.
