ROCHELLE BAVOL: The Commission is being asked to act on a Memorandum and Order responding to a hearing request from Southern Alliance for Clean Energy on an asserted de facto amendment of the operating license held by Florida Power and Light Co. for St. Lucie Plant Unit, 2.

The Commission has voted to approve a Memorandum and Order which denies Southern Alliance for Clean Energys hearing request as untimely and refers Southern Alliance for Clean Energys safety concerns to the Executive Director for Operations for disposition under 10 C.F.R. § 2.206.

Would the Commissioners please affirm their votes?

CHAIRMAN MACFARLANE: Aye.

COMMISSIONER SVINICKI: Aye.

COMMISSIONER OSTENDORFF: Aye.

COMMISSIONER BARAN: Aye.
