ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about July 31, 2013, to Exelon Generation Company, LLC (Exelon) for a violation associated with a White Significance Determination Process finding identified during an inspection of the Dresden Nuclear Power Station (Dresden), Units 2 and 3. This White finding, an issue of low to moderate safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. The finding involves Exelon's failure to establish a procedure addressing all of the effects of an external flooding scenario at Dresden. Specifically, Dresden procedure DOA 0010-04, Floods, did not account for reactor vessel inventory make up during an external flooding scenario up to and including the probable maximum flood event which could result in reactor vessel water level lowering below the top of active fuel. Exelon's corrective actions were to incorporate methods to provide RPV inventory make up during an external flood into its procedures.
A Notice of Violation (NOV) is included based on Exelon's failure to meet Technical Specification Section 5.4.1, which requires, in part, that written procedures be established, implemented, and maintained covering the applicable procedures recommended in Regulatory Guide 1.33, Revision 2, Appendix A, February 1978. Regulatory Guide 1.33, Revision 2, Appendix A, Paragraph 6 addresses "Procedures for Combating Emergencies and Other Significant Events" and lists Item w, "Acts of Nature (e.g., tornado, flood, dam failure, earthquakes)", as an activity under Paragraph 6 to be covered by written procedures. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.
The NRC issued a preliminary determination letter for this issue on May 7, 2013. On June 6, 2013 and June 21, 2013, Exelon provided a written response. After considering the additional information provided by Exelon, the staff concluded that the finding is appropriately characterized as White.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is: Mailing of Final Significance Determination July 31, 2013 Telephone Notification of Licensee July 31, 2013 The State of Illinois will be notified.
