INTERIM ENDORSEMENT OF NEI 17-01, INDUSTRY GUIDELINE FOR IMPLEMENTING THE REQUIREMENTS OF 10 CFR PART 54 FOR SUBSEQUENT LICENSE RENEWAL AND NEI 17-04, MODEL SLR NEW AND SIGNIFICANT ASSESSMENT APPROACH FOR SAMA
Dear Mr. Hanson and Ms. Ranek:
The Nuclear Regulatory Commission (NRC) received your letters dated December 5, 2017, available at AgencyWide Documents Access and Management System (ADAMS) Accession No. ML17339A596 and June 29, 2017, at ADAMS Accession No. ML17181A468, requesting
endorsement of the attached Nuclear Energy Institute's (NEI's) NEI 17-01, "Industry Guideline for Implementing the Requirements of 10 CFR Part 54 for Subsequent License Renewal," and NEI 17-04, "Model SLR New and Significant Assessment Approach for SAMA, Revision 0,"
respectively. These guidance documents are available at ADAMS Accession Nos. ML17339A599 and ML17181A470.
The staff has reviewed the NEI 17-01 document to ensure that prior NRC comments provided in public meetings on August 24, 2017 (ADAMS Accession No. ML17257A299) and November 14, 2017 (ADAMS Accession No. ML17346B294) were adequately addressed. The revised version of NEI 17-01 provided in your letter adequately addresses the staff comments and the agreements made at the November 14, 2017, meeting. The NRC will determine whether to formally endorse NEI 17-01 through the revision process for Regulatory Guide 1.188. In the
interim, the NRC finds NEI 17-01, dated Decem ber 2017, acceptable for use by the four licensees that have already communicated to the NRC their intent to apply for SLR before the end of calendar year 2019. The document will provide sound, clear interim guidance to these SLR applicants while formal NRC endorsement of the NEI guidance document is considered through the Regulatory Guide revision process. The NRC expects that the formal revision to Regulatory Guide 1.188 and its issuance for use will supersede the approval for interim use by this letter on or before December 2019.
No clarifications are needed at this time although changes may be made as the NRC goes through our revision and approval of Regulatory Guide 1.188, "Standard Format and Content
J. Hanson and For Applications to Renew Nuclear Power Plant Operating Licenses," including changes to respond to public comments.
The staff has also reviewed the NEI 17-04 document, dated June 29, 2017, and finds it acceptable for interim use by the same four licensees that have communicated their intent to apply for SLR before December 31, 2019. The document provides sound, clear guidance to SLR applicants while formal NRC endorsement of NEI 17-04 is proceeding by revision to Supplement 1 to Regulatory Guide 4.2. The NRC expects that issuance of the formal revision to the regulatory guide on or before December 31, 2019 will supersede the approval for interim use granted by this letter.
No clarifications on NEI 17-04 are needed at this time although changes may be made as the NRC revises Supplement 1 to Regulatory Guide 4.2, "Preparation of Environmental Reports for Nuclear Power Plant License Renewal Applications," including changes in response to public comments.
This letter is being reissued to correct ADAMS Accession No. ML17341B105 for referenced documents and supersedes the previous letter issued on December 20, 2017.
