shorttimeperiodbythecitizenintervenors whohavebeendeniedfundingandotherprocedural assistance andaccesstovirtually alldocuments soughtbyintervenors ondiscovery.

TheBoardhasalreadyruledonthemattenowathand.OnOctober30,1979,thisBoardpostponed discovery onhealthandsafetyissuesuntiltheendoftheenvironmental phaseoftheproceeding (LBP-79-31, 10NRC597;alsonotedinALAB-613).

AlthoughECNPhascontinued andnowcontinues toobjecttotheburdensome andunreasonable andunnecessary totalnumberofinterrogatories imposed,itwasinpartthispostponem ntofaportionoftheexcessive burdenthatultimately enabledECNPtofulfilltheBoard'sordertorespondtotheinterrogatories onenvironmental issues.2Theenvironmental hearingshave'notyetevenbeenscheduled, muchlesscompleted, andhencetheenvironmental'hase isfarfromended.Furthermore, Intervenors learnedofthismotionvianewspaper

theLettertoAllLicensees of0eratinPlantsandAlicantsfor0eratinLicensesandHoldersofConstruction Permits,DatedSeptember 5,1980,fromD.G.Eisenhut, OfficeofNuclearReactorRegulation; andwithdirectives relatingtoAnticipated Transients withoutScram(ATMS),interactions betweencontrolroddrivesystemsandnon-essential controlairsystems,andvariedandnumerousothersafetyissuespertaining toBoilingMaterReactorswhichmayhavearisenorbeenexacerbated byreactoroperating experiences bythatuncertain futuretine.Itwillbewellovertwoyears,attheminimum.beforetheenvironmental phasehasbeencenpleted fromthetimeoftheoriginalfilingofsafetycontentions inthisproceeding, twoyearsfilledwitheventsthattheNRChadbeenconfident inthatinnocentyearof1978wouldnevertakeplace.Inaddition, theECNPintervenors are,astheComnission wellknows,presently engagedinassisting theComnission todothejobitfailedtodointhelicensing ofTMIinseveralotherTMI-related administrative proceedings.
