Dear Toby Neugebauer:

Thank you for your continued engagement with the U.S. Nuclear Regulatory Commission (NRC) as we work together to advance the review of the combined license application for the President Donald J. Trump Advanced Energy and Intelligence Campus, Units 1-4.

As noted in our September 5, 2025, letter regarding the acceptance of the combined license application, the NRC acknowledges Fermi Americas commitment to participate in the applicant-prepared National Environmental Policy Act of 1969, as amended (NEPA) document pilot program.

In accordance with NEPA, as amended, and pursuant to 42 U.S.C. § 4336a(f), this letter serves as formal notice that Fermi America has elected to participate in the NRCs voluntary pilot program for the preparation of an applicant-prepared environmental impact statement. We value Fermi Americas support for this initiative and commitment to innovation and transparency in environmental stewardship, and we look forward to working together to facilitate a timely and effective environmental review.

We understand that Fermi America has engaged an applicant-hired contractor to support this effort, and we welcome the opportunity to coordinate closely throughout the process as described below. The NRC remains committed to supporting your team and stands ready to provide guidance, feedback, and oversight as needed.

To ensure a successful and efficient review, the following delineation of responsibilities and commitments will guide our work:

T. Neugebauer NRC Responsibilities:

The NRC is responsible for complying with NEPA and certain requirements in other statutes and regulations (e.g., Endangered Species Act of 1973 (ESA) and National Historic Preservation Act of 1966 (NHPA)). The NRC will do the following:

1. Determine the level of NEPA review.
2. Assist applicants and applicant-hired contractors by providing guidance, overseeing, and outlining the types of information required for the preparation of the environmental document.
3. Work with the applicant to define the purpose and need for the project, and, when appropriate, to develop a reasonable range of alternatives to meet that purpose and need.
4. Develop and modify, as appropriate, a schedule for preparation of the environmental document. This includes establishing a project start date for use in tracking timeliness requirements under the NEPA Fiscal Responsibility Act of 2023 (FRA) amendments. Major changes to the schedule or related matters (e.g., extension requests associated with FRA timeliness requirements) will be documented through written correspondence.
5. Work with the applicants and applicant-hired contractors to ensure the analysis is focused on areas where there is a higher potential for significant effects. Ensure that the scope of analysis and procedural steps are compliant with NEPA and other applicable requirements.
6. Conduct any government-to-government consultation with Tribal governments and any required consultation with other Federal agencies:

The NRC may use the information provided by the applicant or third-party contractor under this provision to inform consultations or other agency processes required under the NHPA, ESA, and other statutes that address the environment or cultural resources.

7. The NRC will consult early with appropriate State, Tribal, and local governments and interested private persons and organizations when their involvement is reasonably foreseeable. The NRC will also commence its NEPA process at the earliest reasonable time.

Nothing in this process is intended to delegate, or authorize the NRC to delegate, to an applicant-hired contractor, any NRC obligation apart from preparation of a draft NEPA document, including any obligations to consult with other Federal, Tribal, or State entities under the NHPA or ESA or the obligation to engage in government-to-government consultation with Tribes.

8. The NRC may request from an applicant environmental information for use by the NRC in preparing or evaluating an environmental document. This may include a decision file consisting of any factual, scientific, or technical information used, developed, or considered by the applicant or applicant-hired contractor in the course of preparing the environmental document, including any correspondence with the NRC or with third parties.
9. Independently evaluate and take responsibility for the NEPA documents contents. The NRC is responsible for the accuracy, scope, and content of all environmental documents and supporting information.

T. Neugebauer 10. Determine whether to issue the document. The NRC may choose in its discretion to accept, edit, revise, or independently author sections of the document or the whole document. The NRC will include a statement in the document confirming that NRC has independently reviewed the document.

Applicant and Contractor Responsibilities:

The applicant and applicant-hired contractor will do the following:

1. Use experienced contractors. The applicant will provide the credentials and experience of its proposed contractor to the NRC, to demonstrate that the proposed contractor satisfies the requirements of this paragraph. All costs of using a contractor to prepare an environmental document will be borne by the applicant. All contractors must submit an organizational conflict of interest disclosure statement.

Organizational conflict of interests may exist where the contractor and/or its employees have a past, present, or ongoing financial interest in a project to be covered by the contract.

2. Provide all information requested by the NRC that is relevant to the NEPA review, in a timely manner to support the schedule for completing the NEPA document review. This may include any factual, scientific, or technical information used, developed, or considered in the course of preparing the NEPA document, including any correspondence with the NRC or other parties.
3. Include in the NEPA document the names and qualifications of the persons who were primarily responsible for preparing the document or significant supporting material.
4. If the NRC determines that the NEPA document is likely to be insufficient, the NRC may request that the applicant replace its contractor or take control of the completion of the NEPA document.
5. Develop a consolidated administrative record of the information assembled and used to prepare the NEPA document and provide that record within two weeks of the NRCs request. The applicant must be prepared to discuss its strategy for ensuring compliance with this paragraph at any time requested by the NRC. The applicant and the applicant-hired contractor are advised that any materials included in the administrative record may be subject to Freedom of Information Act requests or included in a subsequent administrative record. Any proprietary or other sensitive information, including sensitive cultural or natural resources information, should be clearly marked, segregated from other materials, and recorded in a contemporaneously prepared document log.
