WITHDRAWAL OF LIMITED WORK AUTHORIZATION, EXEMPTION REQUEST, TOPICAL REPORTS, AND CYBERSECURITY METHODOLOGY WHITE PAPER ASSOCIATED WITH CARBON FREE POWER PROJECT, LLC COMBINED LICENSE APPLICATION

Dear Mr. Baker and Mr. Volkoff:

On July 31, 2023, the U.S. Nuclear Regulatory Commission (NRC) received a limited work authorization (LWA) application and an associated exemption request from Carbon Free Power Project (CFPP), LLC and NuScale Power, LLC (NuScale), respectively, to obtain NRC approval to conduct certain early construction activities at the CFPP Site1. On September 5, 2023, the NRC staff accepted and docketed CFPPs LWA application for detailed review2.

On November 10, 2023, CFPP and NuScale submitted a letter3 requesting the withdrawal of the LWA application, exemption request, and the topical reports associated with the CFPP combined license application. Furthermore, on November 16, 2023, NuScale submitted a followup letter and requested the NRC staff to suspend its review of the NuScales Cybersecurity Methodology White Paper and requested that the staff provide the readiness assessment closure letter with a summary of the staffs observations and feedback4.

The purpose of this letter is to inform you that, effective November 16, 2023, the NRC staff has terminated its review of the submittals referenced in your November 10 and 16 letters and has closed the Enterprise Project Identifiers associated with them. Additionally, the NRC staff is in the process of finalizing its readiness assessment summary report and plans to issue it by the end of November 2023.
