NRC Licensing Action & Comment Opportunity Notification The NRC is planning to approve a request submitted by NorthStar Vallecitos, LLC (NSV) for the Vallecitos Boiling Water Reactor (VBWR). On February 3, 2025, NSV submitted a request to terminate the VBWR license and requested an exemption from the 10 CFR 50.82(a)(11)(ii) requirement to submit "nal radiation survey and associated documentation to demonstrate that the VBWR meets the criteria for license termination in 10 CFR 20, Subpart E (ML23034A275). NSV copied the Radioactive Materials Licensing Section, Radiologic Health Branch, California Department of Public Health when the request was submitted to the NRC. The NRC did not issue a Federal Register Notice for this licensing action because the regulations do not require either license termination requests or exemption requests to be noticed.
The NRC is also planning to approve a second request submitted by NSV for the Empire State Atomic Development Agency (ESADA) Vallecitos Experimental Superheat Reactor (EVESR). On April 11, 2025, NSV submitted a request to accept the in-situ radioactive material from the VBWR (ML25102A001). NSV also copied the Radioactive Materials Licensing Section, Radiologic Health Branch, California Department of Public Health when this request was submitted to the NRC. The NRC noticed this request in the Federal Register on May 14, 2025.
