Gentlemen:

2) Letter ET 16-0007, dated March 2, 2016, from J. H. McCoy, WCNOC, to USN RC Docket No. 50-482: Withdrawal of 1 O CFR 50.55a Requests to Use ASME Code Cases N-786-2 and N-789-2 The purpose of this submittal is to withdraw Wolf Creek Nuclear Operating Corporation (WCNOC) requests to use American Society of Mechanical Engineers (ASME) Code Cases N-786-2 and N-789-2, which were submitted in the references.

The Nuclear Regulatory Commission (NRC) published in the Federal Register (81 FR 10780) on March 2, 2016 a proposed rule amending 10 CFR 50.55a. The proposed rule includes the incorporation by reference of Regulatory Guide (RG) 1.147, Revision 18. The proposed revision to RG 1.147 has been published as Draft Regulatory Guide (DG)-1296. RG 1.147, Revision 18 will approve ASME Code Case N-786 for unconditional use, and will approve ASME Code Case N-789 for conditional use. As such, WCNOC is withdrawing the requests to use ASME Code Cases N-786-2 and N-789-2.

If however, prior to final approval, RG 1.147, Revision 18 is changed such that the status of either of these two ASME Code Cases are no longer acceptable, WC NOC may resubmit the appropriate 10 CFR 50.55a Requests to the NRC for approval.

This letter contains no commitments. If you have any questions concerning this matter, please contact me at (620) 364-4156, or Cynthia R. Hafenstine (620) 364-4204.
