NRC INSPECTION REPORT NO. 50-237/98013(DRP);

50-249/98013(DRP) AND NOTICE OF VIOLATION

Dear Mr. Kingsley:

On March 18, 1998, the NRC and Commonwealth Edison staffs met in a pre-decisional

enforcement conference about simultaneously inerting or deinerting the drywell and torus spaces

at the Dresden Nuclear Power Station. These activities were discussed in Inspection Reports

No. 50-237/97006; 50-249/97006; and 50-237/98006; 50-249/98006.

Based on the discussions at this meeting, the NRC determined that violations of NRC

requirements occurred. The violations are cited in the enclosed Notice of Violation (Notice), and

the circumstances surrounding the violations are described in the subject inspection report. Due

to the limited safety significance, these violations have been classified as Severity Level IV in

accordance with Nureg 1600, "General Statement of Policy and Proced1.i"res for NRC

Enforcement Action (Enforcement Policy)." These violations are a concern because NRC

involvement was necessary to obtain prompt and thorough resolution of the issue. The first

violation involved a failure to ensure that the design basis was correctly translated into

procedures, such that procedures allowed simultaneous opening of drywall and torus ventilation

valves. This resulted in bypassing the pressure suppression function of the containment system.

Because your corrective actions, as delineated in Licensee Event Report 50-237/97-011 1

eliminated the use of this practice, no response to this violation is required.

The second violation involved the failure to promptly identify and correct the conditions which

allowed bypass of the pressure suppression function following notification of the issue by the

LaSalle Station and by NRC inspectors. Failing to correct this condition resulted in a situation

where plant operators would have bypassed the pressure suppression function if NRC inspectors

had not intervened. You are requested to respond to this violation with the actions taken to

prevent recurrence.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. The NRC will use your response, in part, to

determine whether further enforcement action is necessary to ensure compliance with regulatory

requirements.
