NO. 50-397/93-51

This refers to the special

inspection

conducted

by Mr. F.

R. Huey of this

office on December

8 through

10,

1993, of activities authorized

by NRC License

No. NPF-21.

At the conclusion of the inspection,

the inspectors

discussed

the

findings with those

members of your staff identified in the enclosed report.

Areas

examined dul'ing this inspection

are described

in 'the enclosed

inspection

report.

Within these

areas,

the inspection consisted

of selective

examina-

tions of procedures

and representative

records,

interviews with personnel,

and

observations

by the inspectors.

This inspection

reviewed the Supply System's

employee

concern

program (i.e.,

the Nuclear Safety Issue'Policy/Direct

Line Program) files initiated during

the, last three years

and identified a number of program

weaknesses.

Although

the Supply System recently recognized the need to reinforce its employee

concern

program

(ECP) with additional training,

and has

issued

new procedures

defining the program,

these

procedures

need to more clearly establish specific

requirements

to preclude recurrence

of weaknesses

similar to those identified

'during this inspection.

We are particularly concerned

about the poor evaluation which the Supply

System performed

on

a recent

ECP file involving:

(1) procedure

compliance,

(2) training,

(3) inadequate

technical

review of potential fire seal

deficiencies,

and (4) potential

employee discrimination for raising safety

concerns to licensee

management.

Based

on this inspection,

the employee's

concerns

appear valid and may involve violations of NRC requirements

and fire

seal operability problems.

In response

to this concern,'he

Supply System

performed

a less-than-thorough

evaluation

and missed

an excellent opportunity

to successfully'esolve

these

concerns

and to demonstrate

senior management's

stated

commitment to improved procedure

compliance at WNP-2.

During the exit

meeting you acknowledged

our concern

and committed to complete

a prompt

reevaluation of potential fire seal deficiencies,

as well as perform. an

independent

evaluation of the Supply System's

handling of this

ECP file.

We also note that the involved employee

has submitted

a discrimination

complaint to the Department of Labor.

Any enforcement

action associated

with

the unresolved

items identified in the enclosed report will be the subject

o

separate

correspondence,

pending receipt of the Supply System's

evaluations

and findings of the Department of Labor.

Nevertheless,

-we ~re concerned

that

this potential discrimination example

may not. be isolated,

in that we noted

two additional

examples of Supply System

ECP files that did not include

evidence that employee discrimination concerns

had

been properly evaluated.

You are requested

to specifically address this concern in your evaluation of

the other findings noted during this inspection.

In accordance

with 10 CFR 2.790(a) of the NRC's "Rules of Practice,"

a copy of

this letter and the enclosure will =be placed in the

NRC Public Document

Room.
