UNIVERSITY OF NEW MEXICO RESEARCH REACTOR FACILITY - U.S.
NUCLEAR REGULATORY COMMISSION SECURITY-RELATED INSPECTION REPORT NO. 50-252/2017-201 AND NOTICE OF VIOLATION
Dear Dr. Busch:
From October 3 - 5, 2017, the U.S. Nuclear Regulatory Commission (NRC) conducted a security inspection at the University of New Mexico Research Reactor facility. The inspection included a review of activities authorized for your facility.
The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules and regulations, as well as compliance with the conditions of your license. The inspector reviewed selected procedures and records, observed activities, and interviewed personnel.
Based on the results of this inspection, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The violation was evaluated in accordance with the NRC Enforcement Policy, which can be found on the NRCs Web site at www.nrc.gov by selecting About NRC, How We Regulate, Enforcement, then Enforcement Policy. The violation is cited in a Notice of Violation (Notice) and the circumstances surrounding it are described in detail in the subject inspection report. The violation is being cited in the Notice because it constitutes a failure to meet regulatory requirements that has more than minor safety significance and the licensee failed to identify the violation.
The NRC has concluded that information regarding the reason for the violation and the licensee actions taken to correct the violation and prevent recurrence were adequately addressed during the inspection and documented in the inspection report. Therefore, you are not required to respond to this letter unless the description herein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the Notice. In accordance with Title 10 of the Code of Federal Regulations Section 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system (Agencywide Documents Access and Management System (ADAMS)). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related items contained in the inspection report and Notice, and in accordance with 10 CFR 2.390(d), copies of these documents will not be available for public inspection.
