AFFIDAVIT OF JOHN L. MINNS ON CONTENTION 8 I, John L. Minns, being duly sworn, state as follows:

Contention 8 states:

The proposed method of radiation monitoring during repair of the steam generators will not provide accurate information to comply with 10 CFR Parts 20 and 50.

I have reviewed statements 1, 4-5, and 7-10 of,the statement of material facts accompanying the Applicant's April 8, 1981 motion for summary disposition of contention 8 and, based on commitments made by the Applicant on the record and the results of past inspections of the Turkey Point radiation protection

program, concur therein.

The Licensee wi'll be required to operate in accordance with the radiation protection standards in 10 CFR Part 20.

10 CFR 520.202 states that the licensee shall supply appropriate-personnel monitoring equipment to,, and shall require the use of such equipment by, individuals who are likely to.

receive 25 percent of the limit in 10 CFR 520. 101'(a) or 5 percent of the limits in 520.101(a) for individuals under 18 years of age.

10 CFR 520.103 states that intakes of radioactive materials be maintained below specified limits and that air sampling and bioassays be performed as appropriate.

The Licensee has made a coomitment in the Steam Generator Repair Report (SGGR, 53.3),

to provide personnel dose monitoring instrumentation, including: thermoluminsescent dosimeters, self reading pocket dosimeters, per 10 CFR 520.202(3)(b)(1),

portable air monitors,

samplers, and bioassays in accordance with 10 CFR 520.103.

The Licensee will use calibrated, state-of-art monitors, instruments and equipment.

Such equipment provides acceptable accuracy to show compliance with 10 C.F.R. 20.

I have found the described program adequate (See Staff Safety Evaluation Report (NUREG-0756)

(SER),

5 2.8.1.5 Two NRC resident inspectors are permanently assigned to the site to monitor compliance with NRC regulations.

Their efforts will be supplemented by inspections by NRC Office of Inspection and Enforcement

( I&E) health physics inspectors.

These inspectors check instrument calibration and performance during routine inspections.

On liay 5-16, 1980, the Office of I&E conducted a special appraisal of the health physics program at the Turkey Point site.

The appraisal found the instrumentation (radiation monitoring) at the site to be adequate although improvements were recommended in calibrations, quantity of equipment available, reverification of calibrator and setting of frisker alarms.

Some items were in non-compliance with 10 CFR Part 20.

These items have been corrected by the Licensee.

The Office of I&E has acknowledged their corrective actions and will inspect these areas in a

future inspection.

Based on the information presented in the Steam Generator Repair Report, the Licensee's responses to our review question and the Health.Physics

appraisal program, we conclude that the Licensee intends to implement a

radiation monitoring program that will maintain in-plant radiation exposures within the applicable limits of 10 CFR Part 20 and will maintain exposures as low as is reasonably achievable.
