Dear Mr. Utley:

This is in response to your letter of June 7,1979, to Chainnan Hendrie inquiring what actions this Commission is taking to implement the Council's regulations which became effective on fiarch 1, 1979.

We recognize that the President's memorandum of July 12, 1978, on Environ-mental Quality and Water Resources Management directs Federal agencies with water resources responsibilities to publish draft regulations implementing the Council regulations by May 31, 1979.

It is not clear that this requirement applies to independent agencies such as this Commission whose primary mission is not related to water resources management. However, we are presently drafting changes in 10 CFR Part 51 of our regulations which are intended to accommodate the Advisory Council's regulations, those of the Council on Environmental Quality (40 CFR Part 1500) and any others which pertain to environmc. ital aspects of our licensing actions. At present, we expect to publish the modified 10 CFR Part 51 regulations on approximately July 30, 1979, the date on which the CEQ regulations become effective.

The above information was conveyed by telephone on June 15 to Mr. Peter Smith of your staff, who indicated that several other agencies are taking a similar approach and that it is acceptable to the Advisory Council.

Mr. Smith is aware that the Commission published in May 1979 the t.ovironmental Standard Review Plans which provide guidance to our staff for review of applications for permits to construct nuclear power plants.

The Advisory Council's regulations were con-sidered in the development of these plans.

We are also attempting to meet the intent of the regulations in current licensing actions. As an example, the recent environmental impact statement on the White Mesa Uranium Project (NUREG-0556) issued by the Commission's Office of fluclear Material Safety and Safeguards includes a preliminary case report pertaining to possible adverse impacts, a proposed memorandum of understanding, and proposed license conditions.
