ANSWER OF THE NRC STAFF TO MOTION OF THE DEPARTMENT OF JUSTICE FOR MODIFICATION OF THE BOARD'S JULY 24, 1979 ORDER RE SCHEDULING On November 30, 1979, the Department of Justice moved this Board for an extension of the current hearing and discovery schedule. The Staff concurs in the Department's proposed schedule. As indicated in the Staff's December 12, 1979 discovery status report, the Staff is now forecasting that Comanche Peak Unit I will be ready for fuel-loading between August 1981 and November 1981. Thus, if the evidentiary hearing were to begin on Wednesday, April 30,1980 (or more likely, Monday, April 28 or Monday, May 5,1980) and were to last six months (until late October-early November 1980), the Board would still have nine to twelve months after the hearing within which to render its initial antitrust decision, without impacting current scheduled fuel-loading. The Department's request can therefore be accommodated utilizing present schedules. Moreover, the motion appears to 1616 007 791gg gg g f
