Docket No. 99900380/79-01 NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on October 29-November 1, 1979, it appears that certain of your activities were not conducted in accord-ance with NRC requirements as indicated below:

Paragraph 21.2 of 10 CFR Part 21 states in part, "The regulations in this part apply also to each individual, corporation, partnership or other entity doing business within the United States, and each director and responsible officer of such organization, that... supplies basic components.

. for a facility or activity licensed, other than for export.

The Regulations (10 CFR 21) also require that procedures be established (adopted) and posting be accomplished.

Stone and Webster Purchase Order (P.O.) No. 2BV-739, dated August 15, 1979, states in part, " COMPLIANCE WITH REGULATORY REQUIREMENTS - 10 CFR 21 -

The equipment, service, or material provided under this purchase order is a basic component of a Nuclear Regulatory Commission (NRC) licensed facility or activity. Accordingly, the Seller is subject to the provisions of Part 21,. Chapter 1 of Title 10 of the Code of Federal Regulations (here-inafter 10 CFR 21)."

Contrary to the above, procedures had not been established for implemen-ting 10 CFR 21 which had been invoked by Stone and Webster P.O. No. 2BV-739, dated August 15, 1979.

This is an infraction.
