Dear Heyward:

This is to confirm the conments made to you regarding the recent regulatory program review by Mr. Kendig and Mrs. Schneider.

Based on the results of the review, the staff believes that the Department's program for control of agreement materials is adequate to protect the public health and safety and comratible with the Commission's program.

During discussions with the staff in conjunction with compliance file reviews, it was revealed that State inspectors do not perform independent measurements of the radiation output of teletherapy units.

We noted the concerns expressed by the staff concerning their ability to do these measurements, however, we recommend that independent measurements of the radiation output of teletherapy units be performed.

Independent verification measurements by the inspector are not required of licensees who routinely participate in a program of national recognition, providing that the inspector can examine the licensee's records of their participation in such a program and that the licensee has taken adequate corrective action for identified discrepancies.

I appreciate the courtesy and cooperation extended to Mr. Kendig by you and your staf f during this review.
