ORDER SUBSEQUENT TO THE PREHEARING CONFERENCE (October 2, 1980)

On August 18, 1980 (45 Fed. Reg. 54915) the Board scheduled a prehearing conference for September 25, 1980 in the Federal Courthouse, Los Angeles, California.

The order provided that Petitioners, Committee to Bridge the Gap, could supplement its prior petition no later than August 25, the Applicant response no later than September 9 and the Staff response no later than September 17.

Timely responses were received.

In considering the question of " interest" of the Petitioners, the Staff supported a favorable finding and the Applicant had no objection to finding that " interest" was established.

The Board determined that the Petitioners satisfied the interest requirement.

The Board determined that it would proceed in the con-sideration of contentions by going to six contentions the Staff had fully supported in the response of September lf.

Following the opportunity for further discussion, the Board accepted Contention II(Tr.30), Contention III(Tr.35),

Contention IV(Tr.35) and Contention VII(Tr.40).

The con-tentions were accepted as rephrased by the Staff.

Consideration of Contentions VI and XX was deferred because the Staff announced at the prehearing that it was changing its prior position.

Having established " interest" and one or more acceptable contentions, the Petitioners were granted Intervenor status.

The remaining contentions the Staff supported in part, objected to in part, alleged duplications and confused state-ments.

The Board determined that it would first give the parties an opportunity to try to resolve the differences and, if possible, reach a stipulation.

The Staff was requested to make a status report to the Board in thirty days.

The Staff stated that the Safety Evaluation Report would probably be issued on April 1, 1981.

It should have been "Allens Creek."
