RESPONSE TO SES-RELATED OUESTIONS OUESTION 1.

What steps are you taking to inform career members of the Senior Executive Service of their rights to refuse reassignments duri'ng the first one hundred and twenty days of a new Administration or of a new agency head or of a non-career supervisor?

ANSWER.

The 120-day moratorium on involuntary r'eassignments applies only after the appointment of a new agency head or the appointment of an immediate supervisor who is a non-career appointee and who has authority to remove or reassign a career executive.

This protection built into the law came into effect in NRC on Ma,ach 3, 1981, when the President appointed a new Chairman.

Since then, the personnel office has had responsibility for assuring that reassignment actions are not processed within the 120-day moratorium period without advising career SES members of their right of refusal.

OUESTION 2.

Have any career Senior Executives been reassigned, transfered, promoted, or demoted since January 20, 1981? Were any reassign-ments or transfers involuntary on the part of the Senior Executive?

ANSWER.

There has been one reassignmen; of a career SES member since January 20, 1981.

The one reassignment was voluntary.

OUESTION 3.

How many vacant positions does your agency have? How many must be filled by career Senior Executives? How many may be filled by non-career Executives?

ANSWER.

NRC has 22 existing vacancies.

Thirteen are career reserved and must be filled by career Senior Executives.

Nine are general positions and may be filled by non-career Executives. The agency's current OPM allocation, hcwever, restricts N,RC to no more tnan five additional non-career appointments at this time.

OUESTION 4.

How many Senior Executive Service positions does your agency have outside of Washington, D.C. area? Where are they and what are the job titles?

ANSWER.

The NRC has a total of_11 SES positions outside the Washington, D.C. area.

Director and Deputy Director positions exist in each of NRC's five Regional Offices:

Philadelphia, Atlanta, Chicago, Dallas, and San Francisco.

In addition, a position of Deputy Director, TMI Program Office, Office of Nuclear Reactor Regulation, has been established in Middletown, Pennsylvania.

OUESTION 5.

Do yon plan to ask Senior Executives to transfer or accept reas',ignments in the next six months? Why woulc such moves be ne 4ssary or desirable?

ANSWER.

The agency anticipates making some reassignments of SES members within the next six months, in order to accommodate reorganiza, tion plans that are designed to eliminate functional cuplication ano enhance operational efficiency.

QUESTION 6.

Has your agency hired new Senior Executives since January 20, 1981? Please list their names (in alphabetical order), the positions each filled, and whether each is a career or non-career appointee.

ANSWER.

The NRC has not made any new SES appointments since January 20, 1981.

OUESTION 7.

What plans do you have to provide for the rating of Senior Executives whose supervisors left the government prior to January 20, 1981.

ANSWER.

The NRC SES Appraisal System provides that a Supervising Executive prepare a special appraisal and rating for the Senior Executive (s) under his/her supervision, prior to separation or transfer.

This appraisal is integrated into the regular performance review.

-QUESTION 8.

How many Senior Executives have left your agency since:

November 4, 1980? How many were career members? How many of the career members who left retired from government service?

ANSWER.

Since November 4, 1980, three Senior Executives have left the agency.

The individuals were all career SES members and all resigned to accept employment with private industry.

None of them retired.
