Dear Administrative Judges:

On May 15, 1981, Applicant General Electric Company filed a " Motion To Compel Discovery Against Intervenor State of Illinois," in view of the apparent failure of Illinois to comply with the Licensing Board's April 20, 1981 Order requiring Illinois to answer Applicant's March 19, 1981 dis-covery requests by May 5,1981.

On May 21, 1981, t'le NRC Staff filed a motion for sanctions against the State of Illinois iecause of Illinois' failure to answer the Staff's l

discovery requests, nd to comply with the Licensing Board's Orders granting l

I the Staff's motions.o compel Illinois to answer those discovery requests.

In its motion, the Staff set forth its position as to a party's obligation

to respond to the discovery requests of other parties and to comply with i

Licensing Board orders relating to discovery matters. The Staff has no

- additional views to express on this subject. Accordingly, we inform the Board that the Staff does not intend to submit a response to Applicant's motion.
