This refers to the routine safety inspection conducted o, b

Riedli,1ger of this office on May 26-28, 1981 of activities authorized by NRC License No. 46-09750-02 and to the discussion of our findings held by Ms. Riedlinger with you and other members of your staff at the conclusion of the inspection.

The results of this inspection were also reviewed with you and your staff in an Enforcement Conference on June 23, 1981.

That conference will be described in an NRC report which will be distributed later.

The inspection was an examination of the activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and the conditions of your license.

The inspection consisted of selective examinations of procedures and representative records, interviews with personnel and observations by the inspector.

During this inspection, it was found that certain of your activities appeared to be in noncompliance with NRC requirements. The items and references to the pertinent requirements are listed in Appendix A.

These items have been categorized into severity levels as described in the Federal Register Notice (45 FR66754) dated October 7, 1980.

Research activities conJucted on the hospital premises were licensed under the University of Washington license WN-C001-1 until December 16, 1980.

On that date, Amendment 18 of the state license was issued, deleting the USpHS Hospital as a location of use-On May 20, 1981, Amendment 1 was issued to the hospital's NRC License 46-09750-02, which originally authorized certain nuclear medicine procedures.

Since Amendment 1 authorizes the use of radioactive materials for research purposes, further response to item E. as described in Appendix A is not required.

The findings from this inspection, as well as the one conducted on June 5, 1978, indicate a repetitive item of noncompliance (see Appendix A, Item D.3.).

Dept. of Health, Education & Welfare June 30, 1981 We are concerned about the repetitive nature of the items of noncompliance observed during our. inspections.

In addition to the need for corrective action regarding the specific items of noncompliance included in Appendix A, we are concerned about the implementation of your management control system that permitted one item of noncompliance to recur.

Consequently, in your reply you should describe in particular those actions taken or planned to improve the effectiveness of your overall management control system.

Your response to this notice is to be submitted in accordance with the provisions of 10 CFR 2.201 as stated in Appenoix A, Notice of Violation.

We have adopted a new NRC cnforcement policy, as described in the Federal Register Notice (45 FR 66754) dated October 7,1980. With the adoption of that policy we are requiring, under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, that responses to Notices of Violations be submitted under oath or affirmation.

Therefore, the last paragraph of your letter should include a statement equivalent to the following:

I certify that all information contained in this letter, including any supplements attached thereto, is true and correct co the best of my knowledge and belief."
