SUBJECT:

NRC INSPECTION REPORT 70-7002/98013(DNMS) AND NOTICE OF VIOLATION

Dear Mr. Miller:

On August 31,1998, the NRC completed a routine resident inspection at your Portsmouth Gaseous Diffusion Plant. The enclosed report presents the results of that inspection. The results of our inspection over a six week period covered by the enclosed report indicate that the conduct of activities at the Portsmouth Gaseous Diffusion Plant was generally adequate.

Based upon the results of the inspection the NRC has determined that a violation of NRC requirements occurred. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surroundir,g the violation is described in detailin the enclosed report. The violation is of concern because you made a non-conservative decision to continue affected operations without Plant Operations Review Committee approval of multiple Nuclear Criticality Safety Approvals, in non-compliance with your Technical Safety Requirements.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements, in accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosures and your response will be placed in the NRC Public Document Room.
