APPLICANTS' RESPONSE TO NEW ENGLAND COALITION ON NUCLEAR POLLUTION'S MOTION FOR RECONSIDERATION OF LICENSING BOARD'S MEMORANDUM AND ORDER OF DECEMBER 4, 1986-Under date of December 19, 1986, New England Coalition on Nuclear Pollution (NECNP) filed a motion for reconsideration of the scheduling order handed down by this Board on December 4, 1986.

Four complaints are made.

The first complaint is that the schedule will require NECNP's counsel to work over the holidays in order to meet the' filing deadline imposed for answering to the positions taken by the Staff on contentions.

This is now moot.

The second complaint is the lack of a prehearing conference to provide an opportunity for oral argument with respect to the proffered contentions.

such an argument and therefore there is no requirement that there be a prehearing conference.

All that is necessary is that the offeror of the contention be given an opportunity to be heard; provision for a written reply fully satisfies that rule.

See Houston Lighting & Power Co. (Allens Creek Nuclear Generating Station), ALAB-565, 10 NRC 521, 525 (1979).

The third complaint is the shortness of the contemplated discovery period.

There is no reason for further lengthy discovery on the New Hampshire Plans.

The Board should adhere to the position it has taken on this matter.

The fourth complaint concerns the allegedly too short time allowed for preparation of testimony.

This matter is one committed to the discretion ofd the Board.

The time does not seem unreasonable to the Applicants.
