LICENSING SUPPORT NETWORK ADVISORY REVIEW PANEL Membership Balance Plan
- 1. Committee Name: Licensing Support Network Advisory Review Panel (LSNARP)
- 2. Authority. Established as a discretionary Committee pursuant 10 CFR 2.1011(d)
- 3. Mission/function. The Nuclear Regulatory Commission's (NRC) Rules of Practice in 10 CFR Part 2, Subpart J, establish the basic procedures for the submission and management of records and documents relating to the licensing of a geologic repository for the disposal of high-level radioactive waste (HLW). The procedures include the use of an electronic information management system known as the Licensing Support Network (LSN). The LSNARP shall provide advice on systems necessary to access the LSN; the operation and maintenance of the electronic docket established for the HLW geologic repository licensing proceeding; and on solutions to improve the functioning of the LSN. In addition, it will advise on operation and maintenance of the electronic docket established for the HLW licensing proceeding; procedures and standards for the electronic transmission of filings, orders, and decisions during the HLW repository licensing proceeding; and other duties as specified in 10 CFR Part 2 or as directed by the Secretary of the Commission or the Chief Administrative Judge, Atomic Safety and Licensing Board Panel (ASLBP).
- 4. Points of View. The LSNARP is a representational committee with membership drawn from among the full spectrum of participants in NRC's HLW repository licensing proceeding. Since the repository site under review is at Yucca Mountain in Nevada, the membership includes the State of Nevada; local county governments in both Nevada and California; Native American tribes, including the National Congress of American Indians and tribes that are parties to the HLW licensing proceeding adjudication; and a public interest group (the Nevada Nuclear Waste Task Force). It also includes the nuclear industry, the potential licensee (DOE), and the licensing agency (NRC). Input by these representatives is essential to the success of the LSN project.
- 5. Other Balance factors. The membership of the Panel is made up of representatives of participants to the NRCs HLW licensing proceeding and other interested organizations. Under 10 CFR 2.1011(d), the Secretary of the Commission has the authority to appoint additional representatives to ensure inclusion of participants in the HLW repository licensing proceeding adjudication.
- 6. Candidate Identification Process. Original identification of groups to be represented on the LSNARP grew out of a Publicly Noticed Negotiated Rulemaking conducted by the NRC that resulted in 10 CFR Part 2, Subpart J. Potential parties to the anticipated
adjudicatory proceeding were asked to participate in the development of the procedures for conducting the licensing of a HLW geologic repository. All participants in the original rulemaking are represented on the Panel, with others added as they have been identified as parties or interested governmental entities in the HLW licensing proceeding adjudication.
- 7. Subcommittee Balance. Subcommittees and working groups will have the same representational balance as the full Committee. The full Committee reviews and approves any recommendations developed by subcommittees.
- 8. Other. The NRC Secretary has the capability to add members to include any group not currently represented that is admitted as a participant to the adjudication for the HLW repository licensing proceeding.
