STATUS OF RECOMMENDATIONS: AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS PROCESSES FOR DEPLOYING REACTIVE INSPECTION TEAMS (OIG-23-A-06)

REFERENCE:

DEPUTY EXECUTIVE DIRECTOR FOR REACTOR AND PREPAREDNESS PROGRAMS MEMORANDUM DATED JUNE 9, 2023 Attached is the Office of the Inspector Generals (OIG) analysis and status of recommendations as discussed in the agencys response dated June 9, 2023. Based on this response, recommendations 1.1 through 3.1 remain open and resolved. Please provide an updated status of the open, resolved recommendations by December 31, 2023.

Audit Report AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS PROCESSES FOR DEPLOYING REACTIVE INSPECTION TEAMS Status of Recommendations (OIG-23-A-06) 2 Recommendation 1.1:

Update agency policies to require that staff provide complete information on screening evaluation forms, correctly profile evaluation forms in the Agencywide Documents Access and Management System (ADAMS), and publicly share non-sensitive reactive inspection screening decision-making, whenever possible.

Agency Response Dated June 9, 2023:

The staff agrees with the recommendation. The Office of Nuclear Reactor Regulation (NRR) intends to revise Inspection Manual Chapter (IMC) 0309, Reactive Inspection Decision Basis for Reactors, to direct staff to provide sufficient information for each criterion response and to clarify the profiling process in ADAMS. Those completed event evaluation forms identified in OIG-23-A-06 as not correctly profiled in ADAMS will be re-profiled. With respect to the public release of non-sensitive screening forms, the staff intends to revise IMC 0309 to direct staff to further profile decision documentation enclosures in accordance with Management Directive (MD) 3.4, Release of Information to the Public. The staff will publicly release non-sensitive screening forms either after an inspection is completed and the associated inspection report issued or when a decision is taken that no further inspection is warranted.

The OIG will close this recommendation upon (1) reviewing the revisions to IMC 0309 directing staff to provide sufficient information for each criterion response, clarify the profiling process in ADAMS, and directing staff to publicly release non-sensitive information screening forms either after an initial baseline inspection is completed and

This recommendation remains open and resolved.

Audit Report AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS PROCESSES FOR DEPLOYING REACTIVE INSPECTION TEAMS Status of Recommendations (OIG-23-A-06) 4 Recommendation 2.1:

Update agency policies so that they provide a well-defined incident screening process with examples for screening reactor safety and security events.

Agency Response Dated June 9, 2023:

The staff agrees with the recommendation. NRR intends to revise IMC 0309 to provide criteria screening examples to assist staff in completing decision documentation enclosures.

Audit Report AUDIT OF THE U.S. NUCLEAR REGULATORY COMMISSIONS PROCESSES FOR DEPLOYING REACTIVE INSPECTION TEAMS Status of Recommendations (OIG-23-A-06) 5 Recommendation 3.1:

Periodically assess the effectiveness of MD 8.3, NRC Incident Investigation Program, and IMC 0309 implementation.

Agency Response Dated June 9, 2023:

The staff agrees with the recommendation. The Office of Nuclear Security and Incident Response intends to leverage and enhance the process to periodically review MD 8.3 and IMC 0309 implementation as directed in MD 8.3, section III.H.8.
