Indiana Draft Agreement Application Status
Dear Courtney Eckstein:
We are providing an update on the status of the Indiana Draft Agreement Application received on April 1, 2024. ML24108A164. This application was reviewed by a team comprised of members from NRCs Office of Material Safety and Safeguards (NMSS), Region III, and Office of General Counsel (OGC). The team concluded that the application needed more robust management and implementation details regarding a comprehensive, new Agreement State regulatory program.
On May 14, 2024, Sherrie Flaherty and I, met with you and Clayton Kinder to discuss the status of this application. While recognizing Indianas work in developing the individual aspects of their program thus far, in order to ensure the new Agreement State program is set up to be effective for protecting public health and safety, the review team described the need for additional information and explanation of how those operations integrate into the existing Indiana State regulatory programs. At the meetings conclusion, Indiana committed to revising each section of the application and NRC committed to providing the additional support necessary for Indiana to establish a comprehensive and successful new regulatory program. This meeting was summarized in an email to you sent on May 21, 2024, ML24184A051.
In order to provide effective and efficient assistance, on June 10 and 11, 2024, Sherrie Flaherty, Duncan White, and Darren Piccirrillo joined you and your staff to discuss details of this draft application. This meeting provided specific comments and suggestions for each section of the draft application that Indiana can incorporate into its revised application. Additionally, on June 21, 2024, a senior management level meeting was held to solidify the next steps and path forward toward Indianas Agreement, including completion of Indianas regulation 290 IAC 3, and the revised draft application. The participants of the meeting are listed in Enclosure 1.
Moving forward, we have received Indianas regulation 290 IAC 3 dated June 20, 2024 (ML24173A208), and understand that Indiana will be submitting a revised draft application. This revision will be reviewed by the same NRC team that reviewed the April 1, 2024 application.
The review team will provide comments to Indiana only on the revised application.
