Dear Mr. Warden:
Enclosed is an application (XB1367) dated January 26, 2024, accepted by the U.S. Nuclear Regulatory Commission, from Troxler Electronic Laboratories, Inc. requesting the export of three devices. Each device contains a Cesium-137 source with an activity level of 333 megabecquerels (MBq) each, for a total of 999 MBq, and an Americium-241/Beryllium source with an activity level of 1.63 gigabecquerel (GBq) each, for a total of 4.89 GBq. Both sources will be installed in portable moisture density gauges used for quality control testing of construction materials in Iraq.
Since Iraq is on the embargoed list (10 CFR Part 110.28), before taking action on this request, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended.
