RESPONSE TO NUCLEAR ENERGY INSTITUTE LETTER REGARDING REGULATORY IMPROVEMENTS TO POWER UPRATE LICENSING ACTIVITIES

Dear Dr. Uhle:

The U.S. Nuclear Regulatory Commission (NRC) appreciates your letter dated March 15, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24078A221), in which you provided the industrys perspectives on anticipated power uprate applications and recommendations for improving the efficiency of the NRCs power uprate review processes.

While the NRC has approved approximately 170 power uprate amendments since 2000 and has established processes to support these reviews, our data also indicates a general increase in the amount of resources and the timeline required to conduct these reviews. As such, we are in the process of identifying opportunities to improve and optimize our reviews such that we can, at a minimum, reach the original targets of 6-, 9-, and 12-month schedules for Measurement Uncertainty Recapture uprates, Stretch Power Uprates, and Extended Power Uprates, respectively. As part of this effort, the NRC intends to update its guidance in Office of Nuclear Reactor Regulation Office Instruction LIC-112, Power Uprate Process, as well as other guidance, as appropriate, to reflect the changes.

The NRC will engage with stakeholders through a series of public meetings to obtain feedback as part of this process, as well as to gain a better understanding of the types of uprates and schedules licensees are planning.
