NRC STAFFS RESPONSE TO NUCLEAR ENERGY INSTITUTES TECHNICAL REPORT NEI 21-01, REVISION 2, INDUSTRY GUIDANCE TO SUPPORT IMPLEMENTATION OF NRCS RISK-INFORMED PROCESS FOR EVALUATIONS

Dear Mr. Mauer:

The purpose of this letter is to provide you with the NRC staffs feedback on Nuclear Energy Institutes (NEIs) Technical Report (TR), NEI 21-01, Revision 2, Industry Guidance to Support Implementation of NRCs [U.S. Nuclear Regulatory Commissions] Risk-Informed Process for Evaluations [RIPE], dated October 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23306A074).

The NEI TR includes your recommendations on the NRCs RIPE, provided in your letter dated April 19, 2023 (ML23163A048). The NRC staff held a public meeting on October 5, 2023 (ML23304A269), to discuss its preliminary assessment of NEIs recommendations and documented its preliminary assessment in a letter to NEI dated October 25, 2023 (ML23285A270).

The NRC staff has completed a preliminary review of NEIs RIPE TR, which mainly focused on NEIs recommendations regarding the RIPE criteria. Based on this preliminary review, the NRC staff has identified no major issues with NEIs guidance. This determination does not constitute approval of the TR.

The NRC staff plans to make changes to the NRCs RIPE guidance document, Guidelines for Characterizing the Safety Impact of Issues, dated May 2022 (SIC) (ML22088A135) and the NRCs Temporary Staff Guidance (TSG), TSG-DORL-2021-01, Revision 3, Risk-Informed Process for Evaluations, dated September 18, 2023 (ML23122A014), consistent with the staffs preliminary assessment of NEIs recommendations.

Ultimately, the NRC staff plans to develop a Regulatory Guide to adopt further guidance, best practices, etc., after the staff has completed several reviews using RIPE.
