Kelly, Upon receipt of NRC Region IIs letter dated September 21, 2023 (ML23261A587), the NRC considers License Condition 29 to be fully satisfied. The satisfaction of License Condition 29 will be documented in the next amendment for the American Centrifuge Plant license SNM-2011 that the NRC issues.

[External_Sender] General Agreement - License Condition 29 Importance: High Good morning, ACOs SNM-2011 (Amendment 22) License Condition 29 (re-stated below) was added during our extension to complete Phase I of our HALEU operations.

ACO shall not take possession of Category II quantities of SNM or commence Category II SNM product withdrawal and storage under the HALEU operations contract until such time that the required Category II physical security and material control and accountability operational readiness reviews by the NRC have been completed and ACO has demonstrated adequate compliance with NRC requirements for possessing Category II SNM.

ORRs have been completed and final two clean inspection reports issued. We anticipate NRC Region IIs approval to move into Category II SNM operations in the very near term. I would like to just confirm agreement with you, that upon receipt of this Region II approval, License Condition 29 will have been fully satisfied and we can continue operations up to our currently approved possession limit listed on our withheld materials license today. If we are in agreement, then I will be instructing operations to remove license condition 29 hold points

from our operating procedures with issuance of this final authorization.
