March 1, 2022 The Honorable Thomas R. Carper Chairman, Committee on Environment and Public Works United States Senate Washington, DC 20510

Dear Mr. Chairman:

The U.S. Nuclear Regulatory Commission (NRC) is publishing the following document in the Federal Register:

Title:

Final Rule: Approval of American Society of Mechanical Engineers Code Cases.

  • Description of the rule: This final rule amends current NRC regulations to incorporate, by reference, revisions of three NRC regulatory guides to approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers, as well as one related NRC NUREG (which provides associated guidance to licensees and applicants). This amendment allows power plant licensees and applicants for a variety of regulatory actions to use the code cases noted in regulatory guides as voluntary alternatives to engineering standards for the construction, inspection, and testing of certain nuclear power plant components. Additionally, this rule identifies the availability of a regulatory guide that lists code cases not approved for use by the NRC.
  • Dates: The effective date of this rule is 30 days after publication.
  • This is not a major rule as defined by the Congressional Review Act.

For more information, see the enclosed document.

Please contact me at 301-415-1776 if you have questions or need more information.

Sincerely, Eugene Dacus, Director Office of Congressional Affairs
