Items of Interest Week Ending December 30, 2022 List of Approved Spent Fuel Storage Casks: NAC International, Inc. MAGNASTOR Storage System, Certificate of Compliance No. 1031, Amendment No. 10: Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2022-0144; RIN 3150-AK87]

On December 27, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 79217) confirming the effective date of January 18, 2023, for the direct final rule that was published in the Federal Register (87 FR 66539) on November 4, 2022.

This direct final rule amends the NAC International, Inc. MAGNASTOR Storage System in the List of approved spent fuel storage casks to include Amendment No. 10 of Certificate of Compliance No. 1031. Amendment No. 10 revises the certificate of compliance by adding a new metal storage overpack. The effective date of January 18, 2023, for the direct final rule published on November 4, 2022, is confirmed.

Reporting Requirements for Nonemergency Events at Nuclear Power Plants: Regulatory Basis; Extension of Comment Period; 10 CFR Part 50 [NRC-2020-0036; RIN 3150-AK71]

On December 27, 2022, the NRC published a notice in the Federal Register (87 FR 79258) extending the comment period to allow more time for members of the public to develop and submit their comments for the regulatory basis that was published in the Federal Register (87 FR 67571) on November 4, 2022. The regulatory basis supports a rulemaking that would amend the NRCs regulations for nonemergency event notifications. The NRC is evaluating the current requirements and guidance for immediate notification of nonemergency events for operating nuclear power reactors and assessing whether the requirements present an unnecessary reporting burden. The regulatory basis contains an analysis of whether reporting requirements can be reduced or eliminated when they do not have a commensurate safety benefit.

Reporting Nuclear Medicine Injection Extravasations as Medical Events: Petition for Rulemaking; Consideration in the Rulemaking Process; 10 CFR Part 35 [NRC-2020-0141]

On December 30, 2022, the NRC published a notice in the Federal Register (87 FR 80474) announcing that it will consider in its rulemaking process the issue raised in a petition for rulemaking (PRM), PRM-35-22, submitted by Ronald K. Lattanze on behalf of Lucerno Dynamics, LLC, dated May 18, 2020. The petitioner requested that the NRC amend its regulations to require reporting of certain nuclear medicine injection extravasations as medical events. The NRC will consider the issues raised in PRM-35-22 in rulemaking. The NRC will evaluate the current requirements and guidance for reporting of certain nuclear medicine injection extravasations as medical events. The public can monitor further NRC action on the rulemaking titled, Reporting Nuclear Medicine Injection Extravasations as Medical Events.

The docket for PRM-35-22 was closed on December 30, 2022.
