Mississippi Agreement State Integrated Materials Performance Evaluation Program Review Management Review Board Meeting Minutes May 26 and June 23, 2022 Management Review Board Meeting Objectives: The purpose of the May 26 and June 23, 2022, Mississippi Agreement State Program (Mississippi) Integrated Materials Performance Evaluation Program (IMPEP) Management Review Board (MRB) meetings, was for the MRB to discuss the results of the Mississippi Agreement State Program IMPEP review that was conducted in February 2022, with the IMPEP team and representatives from the State of Mississippi, and for the MRB Chair to determine: (1) the overall adequacy and compatibility of the Mississippi Agreement State Program, (2) the status of the 2017 IMPEP recommendation as well as the need to open new recommendations, (3) the timing of the next IMPEP review(s), and (4) if additional Enhanced Oversight is warranted. The final Mississippi IMPEP report (ML22178A114) is official record of the MRB Chairs decisions.

Meeting Attendees: Meeting attendees for the May 26 and June 23, 2022, MRB meetings are provided in the appendices.

Meeting Minutes - May 26, 2022:

1. Mr. Johnson convened the meeting, outlined the meeting objectives, and introduced the meeting participants. Mr. Johnson noted that this MRB meeting was an NRC public observation meeting, and that members of the public would be given an opportunity to provide comments to the NRC after the business portion of the meeting.
2. Ms. Haney welcomed the meeting participants and made opening remarks on the scope, timing, and mechanics of the IMPEP review and MRB meeting.
3. Ms. Modes introduced the IMPEP review team members, their respective performance indicators, and led the team presentation of the Mississippi IMPEP review results.

Ms. Modes and the respective IMPEP team members summarized the teams findings for each of the performance indicators reviewed. MRB members asked questions and Mississippi was given an opportunity to comment on the teams findings. The IMPEP teams findings are provided below:

3.1. Technical Staffing, and Training: Ms. Modes presented the teams results for the common performance indicator, Technical Staffing, and Training. Her presentation corresponded to Section 3.1 of the proposed final IMPEP report. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was also given the opportunity to provide any additional information or insights. The IMPEP team found, and the MRB Chair agreed, that Mississippis performance with respect to this indicator to be satisfactory but needs improvement.

3.2. Status of Materials Inspection Program: Ms. Forney presented the teams results for the common performance indicator, Status of Materials Inspection Program. Her presentation corresponded to Section 3.2 of the proposed final IMPEP report. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was also given the opportunity to provide any additional information or insights. The IMPEP team found, and the MRB Chair agreed, that Mississippis performance with respect to this indicator to be unsatisfactory.

3.3. Technical Quality of Inspections: Ms. Forney presented the teams results for the common performance indicator, Technical Quality of Inspections. Her presentation corresponded to Section 3.3 of the proposed final IMPEP report. The MRB discussed

3.4. Technical Quality of Licensing Actions: Ms. Cook presented the teams results for the common performance indicator, Technical Quality of Licensing Actions. Her presentation corresponded to Section 3.4 of the proposed final IMPEP report. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was also given the opportunity to provide any additional information or insights. The IMPEP team found, and the MRB Chair agreed, that Mississippis performance with respect to this indicator to be unsatisfactory.

3.5. Technical Quality of Incident and Allegation Activities: Ms. Modes presented the teams results for the common performance indicator, Technical Quality of Incident and Allegation Activities. Her presentation corresponded to Section 3.5 of the proposed final IMPEP report. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was also given the opportunity to provide any additional information or insights. The IMPEP team found, and the MRB Chair agreed, that Mississippis performance with respect to this indicator to be unsatisfactory.

3.6. Legislation, Regulations, and Other Program Elements: Ms. Modes presented the teams results for the non-common performance indicator, Legislation, Regulations, and Other Program Elements. Her presentation corresponded to Section 4.1 of the proposed final IMPEP report. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was also given the opportunity to provide any additional information or insights. The IMPEP team found, and the MRB Chair agreed, that Mississippis performance with respect to this indicator to be satisfactory but needs improvement.

4. Ms. Modes provided a summary of the teams recommendations for the: overall finding of adequacy and compatibility, timing of the next IMPEP review, and need for additional oversight. Based on the results of the IMPEP review, the team recommended that Mississippi be found not adequate to protect public health and safety and not compatible.

The team also recommended that the 2017 IMPEP review recommendations remain open and that 14 new recommendations be opened. The team recommended that several follow-up IMPEP reviews be conducted, with the next full IMPEP be done in 2025. The team also recommended that Mississippi immediately placed in a period of heightened oversight, pending a Commission decision on Probation.

5. The MRB discussed the results of the IMPEP review and asked questions to the IMPEP team and Mississippi. Mississippi was given the opportunity to provide any additional information or insights.
6. Due to time constraints, the MRB Chair did not make a final determination on: (1) the overall adequacy or compatibility of the Program, (2) the timing of the next IMPEP review, or (3) the need for enhanced oversight. Instead, the MRB Chair concluded the May 26, 2022, MRB meeting and directed staff to reconvene the MRB within 30 days. The MRB is being reconvened to discuss the teams recommendations for: (1) the overall performance of the Mississippi Program, (2) the timing of the next IMPEP review, and (3) the level of enhanced

When the MRB is reconvened, the Representatives of the State of Mississippi will be given an opportunity provide remarks on the teams recommendations and any new information related to the States performance, improvements, and/or commitments. The MRB chair will ask questions related to the IMPEP teams recommendations and and/or the States remarks. Based on the results of this discussion and input from the IMPEP review team, MRB members, and the State of Mississippi, the MRB Chair will make a final determination on: (1) the overall adequacy and compatibility of the Program, (2) the timing of the next IMPEP review, and (3) the need for enhanced oversight.

7. There were no comments from any members of the public. The meeting was adjourned.

Meeting Minutes - June 23, 2022:

1. Mr. Johnson convened the meeting, outlined the meeting objectives, and introduced the meeting participants. Mr. Johnson noted that this MRB meeting was an NRC public observation meeting, and that members of the public would be given an opportunity to provide comments to the NRC after the business portion of the meeting.
2. Ms. Haney welcomed the meeting participants and made opening remarks on the scope, timing, and mechanics of the IMPEP review and MRB meeting.
3. Ms. Modes introduced the IMPEP review team members and summarized the MRB Chairs findings for the individual ratings Performance Indicator from the May 26, 2022, MRB Meeting (e.g., 2 SBNI, 4 UNSATs) and recommendations (e.g., keeping the 2017 IMPEP recommendation open, and opening 10 new recommendations).
4. Ms. Modes summarized the teams recommendations for the overall performance of the Mississippi Program (e.g., Not Adequate to protect public health and safety and not compatible), the timing of the next IMPEP review (e.g., two follow-up IMPEP review before the next full IMPEP review in 2025), and that the MRB Chair recommend to the Commission that Mississippi be placed on Probation. Further, that Mississippi immediately be placed on a period of heightened oversight, pending a Commission decision on placing Mississippi on Probation.
5. Mr. Craig from the State of Mississippi indicated that the Program agreed with the teams recommendations and highlighted the States commitment to improving Program performance and referenced a draft Program Improvement Plan that summarized specific planned and/or completed corrective actions.
6. The MRB discussed the teams findings and Mississippis comments and asked questions.
7. Based on the results of this discussion and input from the IMPEP review team, MRB members, and the State of Mississippi, the MRB Chair:

Found Mississippi adequate to protect public health and safety but needs improvement and not compatible.

Directed that Mississippis next full IMPEP review be conducted in February 2023.

Agreed to recommend to the Commission that Mississippi be placed on Probation, and immediately placed Mississippi on a period of heightened oversight, pending a Commission decision on placing Mississippi on Probation.

8. There were no comments from any members of the public. The meeting was adjourned.
