Dear Mr. Sinclair:

We have received the final adopted changes to the Utah Administrative Code in R313-22-35, effective November 15,1996, as enclosed in your letter of December 6, .

1996. We have previously reviewed the rules; as proposed rules, by comparison to the )

equivalent NRC regulations in 10 CFR 30.35. We noted in our letter August 22,1996,  ;

that if the rules were adopted without significant change, they would be compatible.

In an E-mail message to Mr. Richard Blanton of my staff, Ms. Julie Felice of your staff l states that there have been no changes to the rule from the version we previously l reviewed. Based on this message, and our review of the draft rule, we find that the final rule meets the current compatibility criteria.
