Dear Brian Magnuson:

I am responding to your petition for rulemaking (PRM) dated May 31, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20170B161). You requested that the U.S. Nuclear Regulatory Commission (NRC) amend its regulations in Section 50.67 of Title 10 of the Code of Federal Regulations (10 CFR), Accident source term, to codify source term methodologies and the corresponding release fractions.

The NRC docketed the petition as PRM-50-122 on June 18, 2020, and published a notice of docketing and request for public comment in the Federal Register on August 24, 2020 (85 FR 52058). The comment period closed November 9, 2020. The public comments are available at https://www.regulations.gov under Docket ID NRC20200150.

The NRC is denying PRM-50-122. The NRC issued 10 C.F.R. § 50.67 to allow the use of alternative methods of compliance; codifying specific source term methodologies and corresponding release fractions in 10 C.F.R. § 50.67 would unnecessarily limit options for meeting the existing requirements and is not necessary to provide reasonable assurance of adequate protection of public health and safety. The NRC provides detailed guidance for determining source term in Regulatory Guide 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors, Revision 0, issued July 2000 (ML003716792). This guidance document describes one way to meet the requirements in 10 C.F.R. § 50.67.

The reasons for the denial are explained in the enclosed notice, which will be published in the Federal Register. Upon publication of the enclosed notice, the NRC will close the docket for PRM-50-122.
