SUMMER NUCLEAR STATION (VCSNS) UNIT 1 REPORTING RELATED TO NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND STATE CERTIFICATIONS DESC hereby submits a copy of the South Carolina Department of Health and Environmental Control (SCDHEC) Consent Order 22-024-W for NPDES Permit SCG646072 in accordance with VCSNS Operating License Appendix B Section 3.2, Reporting Related to the NPDES Permits and State Certifications. Consent Order 22-024-W covers the violation for not performing Total Residual Chlorine (TRC) analyses by a certified laboratory. The notice of violation for not performing TRC analyses by a certified laboratory as required by South Carolina laboratory certification regulations was provided to the Nuclear Regulatory Commission in a letter dated January 20, 2022 (ML22020A416).

In addition, DESC is providing copies of environmental violations concerning permit limits for NPDES Permits SC0030856 and SCG646072. The violations for NPDES Permit SC0030856 were reported to the SCDHEC via electronic Discharge Monitoring Reports (DMRs) for permit exceedances of the pH Instantaneous Maximum in December 2021 and the Total Suspended Solids Monthly Average in March 2022. The violations for NPDES Permit SCG646072 were reported to SCDHEC via electronic DMRs for permit exceedances of TRC Monthly Average and Daily Maximum in January 2022. The notice of violation for the January 2022 TRC permit exceedances is also included in this submittal.

THE STATE OF SOUTH CAROLINA BEFORE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL IN RE: DOMINION ENERGY SC, INC VC SUMMER NUCLEAR STATION OFF-SITE WATER SYSTEM FAIRFIELD COUNTY CONSENT ORDER 22-024-1 The South Carolina Department of Health and .Environmental Control (Department) and Dominion Energy SC, Inc. (Dominion) have agreed to the issuance of this Consent Order to include the following Findings of Fact and Conclusions of Law.

FINDINGS OF FACT

1. Dominion owns and is responsible for the proper operation and maintenance of the VC Summer Nuclear Station Off-site Water System (VC Summer WWTF) located at 400 Brabham Boulevard, .in Fairfield County, South Carolina. VC Summer WWTF serves Dominion's VC Summer Nuclear Station.
2. The Department issued the National Pollutant Discharge Elimination System (NPDES)

Pennit SCG646072, authorizing VC Summer WWTF to discharge filter backwash to the Monticello Reservoir in accordance with effluent limitations, monitoring requirements and other permit conditions contained therein. The NP DES Permit became effective November 2, 2017 and has an expiration ~ate of December 30, 2020. The NPDES Permit is administratively continued due to an application for renewal of the permit being submitted at least one hundred eighty (180) days before the expiration of the permit.

3. On November 9, 2021, Dominion emailed Department staff regarding operations at VC Sumnier WWTF. Dominion explained the laboratory servicing VC Summer WWTF has not been certified to perform total residual chlorine (TRC) since June 2018. Dominion explained the laboratory is in the process of being recertified for TRC, and until recertified, Dominion will use a certified vendor laboratory for TRC analysis.
4. On November 18, 2021, Department staff issued a Notice ofViolation (NOV) to Dominion for failure to use a South Carolina state certified laboratory for sampling and analysis of TRC for the June 2018 through September 2019, December 2019 through March 2020, October 2020, December 2020, February 2021, June 2021, and July 2021 monthly monitoring periods. The certified copy was delivered on November 22, 2021. No response w~s required because Dominion submitted an explanation of the violation November 9, 2021.
5. On January 6, 2022, Department staff issued a Notice of Alleged Violation. and Enforcement Conference (NOAV/EC) to Dominion via first class and certified mail. The NOAV/EC was delivered January I 0, 2022.
6. On January 24, 2022, Department staff held an enforcement conference with Dominion.

Dominion explained the state certification for TRC was purposefully terminated, but the termination of the certification was not communicated with laboratory personnel for Dominion. Dominion further explained laboratory staff were regularly performing quality control testing while in violation and since identification of the violations, Dominion has been using a South Carolina state certified contract laboratory for TRC measurements. The issuance of a Consent Order containing a civil penalty was discussed.

CONCLUSIONS OF LAW Based upon the above Findings of Fact, the Department reaches the foll owing Conclusions ofLaw:

1. Dominion violated the Pollution Control Act, S.C. Code Ann. § 48-1-ll0(d), Water Pollution Control Permits Regulation S.C. Code Ann. Regs. 61-9.122.41(a) and (e)(l), and State Environmental Laboratory Certification Regulations, S.C. Code Ann. Regs 61-68, by failing to submit to the Deparment analytical results for TRC from a South Carolina certified laboratory as required by NPDES Permit SCG646072.
2. The Pollution Control Act, S.C. Code Ann. § 48-1-330, provides for a civil penalty not to exceed ten thousand dollars ($10,000.00) per day of violation for any person violating the Act or any rule, regulation, permit, permit condition, final determination, or Order of the Department.

NOW, THEREFORE, IT IS ORDERED, CONSENTED TO AND AGREED, pursuant to the Pollution Control Act, S.C. Code Ann. § 48-1-50 and 48-1-100, that Dominion shall:

I. Within fifteen (15) days of the execution date of this Order, submit to the Department documentation verifying Dominion has contracted with a South Carolina certified laboratory to perform sampling and analysis for TRC.

2. Pay to the Department, a civil penalty in the amount of four thousand eighty dollars

($4,080.00) within thirty (30) days of the execution date of this Order.

THE PARTIES FURTHER STIPULATE that Dominion shall pay a stipulated penalty in the amount of four thousand eighty dollars ($4,080.00) should it fail to comply. with any requirement 3

pursuant to this Consent Order. Such penalties shall be due and payable upon written notice to Dominion. The Department's determination that a requirement has not been met shall be final. All penalties due under this paragraph shall be made payable to the South Carolina Department of Health and Environmental Control within thirty (30) days of notification by the Department. The stipulated penalties set forth above shall be in addition to any other remedies or sanctions which may be available to the Department by reason of Dominion's failure to comply with any requirement of this Order.

PURSUANT TO THE ORDER, communications regarding this Order and its requirements, including civil penalty payments, shall be address as follows:

IT IS FURTHER ORDERED AND AGREED that this Consent Order governs only the civil liability to the Department for civil sanctions arising from the matters set forth herein and constitutes the entire agreement between the Department and Dominion Energy SC, Inc, with respect to the resolution and settlement of these civil matters~ The parties are not relying upon any representations, promises, understandings or agreements except as expressly set forth within this Order.

DMR Comments: COMMENT and EXPLANATION of EXCEEDANCE for OUTFALL 014 A grab compliance pH sample of 8 . 8 su was obtained from Outfall 014 and a backup aliquot had the same results from the December 3, 2021 NPDES sampling event . Because the sample results were not indicative of the discharged stream , Chemistry personnel suspected the initial and backup samples were contaminated. Upon investigation , it was determined that the telescoping sample cup was used to check the water quality at Outfall 006B during cleanup efforts for the November 16 , 2021 transformer oil spill. VCS believes the initial pH sample result is due to cross contamination introduced by using the same telescoping sample cup to obtain the monthly sample for Outfall 014 .

A new telescoping sample cup was used an hour later to obtain another sample and another aliquot using what was analyzed using another pH meter . The first sample with the new apparatus was 8 . 36 su and the second aliquot result was 8.39 su . This occurrence has been documented in the station's corrective action program (CR 03611) .

DMR Comments : DESC VCS is skeptical of the TRC 0 . 05 mg/L result for the following reasons :

Prior to the discharge sample , VCS personnel obtained multiple samples from both retention basins and obtained results that were less than 0.05 mg/L (nondetectable).

VCS's reverse osmosis system backwash process only contains raw water , which isn't treated with chlorine.

Throughout the Offsite Water System operating history, TRC has never been detected at the outfall.

There is no significant source of chlorine to the retention basins that could result in TRC level of 0 . 05 mg/L .

The occurrence of TRC res~lts above the permitted limit~ has been entered into the stati;n ' ~ correttive action ~rogram (CR1192303) and is under evaluation to determine the source and the validity of TRC 0.05 mg/L result.
