AUDIT OF NUCLEAR REGULATORY COMMISSIONS DRUG-FREE WORKPLACE PROGRAM IMPLEMENTATION (OIG-20-A-13)

The purpose of this memorandum is to provide a status of the actions taken by the U.S. Nuclear Regulatory Commission (NRC) Office of Administration (ADM) in response to the recommendations contained in the subject audit report.

Recommendation 1: Revise the NRC Drug-Free Workplace Plan to reflect the most up-to-date U.S. Department of Health and Human Services (HHS) requirements.

Agency Response Dated August 7, 2020: Agree. ADM will review and revise the Plan to reflect the most up-to-date HHS requirements. A revised Plan will require approvals from internal offices and from the Substance Abuse and Mental Health Services Administration (SAMHSA).

Target Completion Date: November 30, 2021 CONTACT: Christoph Heilig, ADM/DFS 301-415-7731 OIG Analysis: The proposed actions meet the intent of the recommendation.

The Office of the Inspector General (OIG) will close this recommendation when OIG reviews the revised NRC Drug-Free Workplace Plan and verifies the inclusion of HHS requirements.

Status: Open. Resolved.

ADM will review and revise the Plan to reflect the most up-to-date HHS requirements. A revised Plan will require approvals from internal offices and from the SAMHSA.

Status: Ongoing.

2 Agency Response Dated March 4, 2021: On schedule. The staff has revised the NRC Drug-Free Workplace Plan to include the most up-to-date HHS requirements.

The editorial staff has reviewed the draft, and the NRC Office of the General Counsel has no legal objection. We are collaborating with the Office of the Chief Human Capital Officer to incorporate the most up-to-date HHS Employee Assistance Program (EAP) requirements. Once the EAP requirements have been updated, the NRC will send the document to the National Treasury Employees Union for review. The Deputy Executive Director for Operations will conduct the final internal review before the Plan is sent to the Commission for approval. Upon receipt of Commission approval, the NRC will send the Plan to the SAMHSA for review and approval.

Agency Response Dated August 7, 2020: Agree. ADM will review and revise the Manual to reflect the most up-to-date HHS requirements. A revised Manual will be drafted after the Plan is approved by the SAMHSA.

OIG Analysis: The proposed actions meet the intent of the recommendation.

OIG will close this recommendation when OIG reviews the revised NRC Drug Testing Manual and verifies the inclusion of HHS requirements.

Status: Open. Resolved.

Response: Once the revised NRC Drug-Free Workplace Plan has been approved internally, the NRC Drug Testing Manual will be revised to reflect those changes.

Agency Response Dated March 4, 2021: On schedule. The staff is revising the NRC Testing Manual to include the changes reflected in the NRC Drug-Free Workplace Plan. This draft will follow the same review process for approval; however, review by the SAMHSA is not required). Once the Commission approves it, the document will be effective immediately and available on the NRCs internal Web site.

3 Recommendation 3: Deliver NRCs Drug-Free Workplace Training for Supervisors to NRC supervisors, as required.

Agency Response Dated August 7, 2020: An automatic assignment was established in the agencys Talent Management System (TMS) on May 28, 2020, for the initial drug testing course for all new supervisors. Moving forward, when an employees supervisory status changes from Non-Supervisor to Supervisor, TMS will check for course completion of the New Supervisor Training on Drug Testing and Managing Employees in Troubling Times, and if not completed, TMS will automatically assign the course to the individuals transcript with a due date 6 months from assignment. Since the course is now online it can be taken as soon as assigned and removes the limitation of waiting for in person training. The Drug-Free Workplace Refresher Training for Supervisors was assigned on May 29, 2020, to NRC supervisors who require the training this fiscal year. The refresher training is required every 5 years. It is a manual assignment made each year by the Office of The Chief Human Capital Officer staff in the April-May timeframe to supervisors who have not completed drug-free workplace training in the last 5 years. The training due date is the end of the fiscal year (September 30th), the same year it is assigned.

Status: Closed.

Recommendation 4: Require that the NRC employees who were promoted to supervisors while the Drug-Free Workplace Training for Supervisors was unavailable take the class.

Agency Response Dated August 7, 2020: An automatic assignment was established in the agencys TMS on May 28, 2020, for the initial drug testing course for all new supervisors and supervisors who did not have this initial course listed in their transcript. Completion of this training is due within 6 months from assignment.

4 OIG Analysis: OIG reviewed documentation from NRC that verifies individuals were assigned the Drug-Free Workplace Training for Supervisors after its update. Therefore, we consider this recommendation closed.
