Approve SECY-92-324 without comments. I comments The proposed rule relating to this matter was published in l January 1992, after Commission approval. The rule clarifies l where our rules are implementing statutory enactments on  !

penalties (see my memorandum of October 28, 1991, attached). ,

i The comments received seem to miss the mark as they question the Commission's legal authority to promulgate the rule.

The simple fact is that the Commission is not establishing new penalties, but merely clarifying which sections are applicable.

The concerns of the industry and the medical community on page 3 of the SECY also appear to be frivolous.

of criminal penalties. In its present form. the draft statement doesn't mention requirements for technical information, but the proposed rule is somewhat confusing on this point. It treats some requirements for technical information as substantive.

50.34 and 52.45 for example, but others not, 52.47 and 52.79 for example. Yet the SECY paper seems to treat as substantive all regulations which ray "what information must be provided in a

. license application" (p. 3). A good argument can be made that deficiencies in applications, be they willful or not, are more properly corrected by requests for more information than by threats of punishment. -T4 m r c fc c . tThe Commission is note /nicund; cdvocating that all regulations which may what informatioM must f be in applications should be enforceable by means of criminal penalties, only that readers would be in a better position to l comment if the Commission were clearer about what it is proposing.
