Dear Senator Moseley-Braun:

I am responding to your letter of November 26, 1996, expressing concerns about aspects of the application of Louisiana Energy Services (LES) to construct and operate a uranium enrichment plant in Louisiana.

The matter of LES's application to construct and operate the facility, including the issue of environmental justice which you raised in your letter, i the subject of an ongoing formal adjudication before the agency. Because the Commission must serve as the final agency decisionmaker on these matters, I trust you will understand why I cannot respond to the substance of the issues raised in your letter without raising questions of prejudgment on these matters. Let me assure you, however, that the Commission takes its health and safety and environmental responsibilities very seriously, and we will fully

-consider these matters as they come before us.
