STAFF REQUIREMENTS - BRIEFING ON STATUS OF URANIUM RECOVERY (SECY-99-011, SECY-99-012, SECY 013),9:00 A.M., THURCDAY, JUNE 17,1999, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)

The Commission was briefed by four separate panels on the status of uranium recovery and associated policy issues. The first panel consisted of the NRC staff. The second panelincluded representatives from the Department of Energy, the State of Utah (a Non-Agreement State for 11e(2) byproduct material), and the Conference of Radiation Control Program Directors which also provided the views of the Organization of Agreement States, and an Agreement State -

Texas. The third panel consisted of industry groups and included representatives from the Wyoming Mining Association, the National Mining Association, and the Fuel Cycle Facilities Forum. The fourth panelincluded the counsel for the Southwest Research and Information Center.

The Commission requested the Office of the General Counsel to provide its paper on the concurrent jurisdiction of non-radiological constituents at mill facilities to the Commission as soon as practical.

Based on the OGC analysis, the staff should provide its paper on concurrent jurisdictionalissues ,

in a timely manner. The Commission' will provide its views on SECY-99-011, SECY-99-012, and SECY-99-013 following receipt and review of this additional paper. In addition, the Commission is considering the issue of alternate feed in its review of LBP-99-5 (Docket 40-8681-MLA-4).

o coordinate closely with the EPA-Denver office and EPA Headquarters, including additional discussions at meetings of the Interagency Steering Committee on Radiation Standards, to inform them in detail of NRC staff proposals and solicit input. .

! Memoranda of Understanding with EPA and the EPA authorized states as related to the staff's recomtnendation for regulations of ground water at ISL facilities.
