SUPPORTING STATEMENT FOR NRC-7 APPLICATION FOR LICENSE TO EXPORT NUCLEAR EQUIPMENT AND MATERIAL

' Description of the Information Collection The Nuclear Regulatory Commission (NRC), under the Atomic Energy Act of 1954, as amended, and Title II of the Energy Reorganization Act of 1978, as amended, has authority for exercising export and import controls over nuclear equipment and material as listed in 10 CFR Part 110 Sections 110.8 and 110.9. All persons who wish to export nuclear equipment and material.

'A. JUSTIFICATION

1. . Need for the Collection of Information. Sections 110.30 and 110.31 require

' license applications from all persons in the U.S. who wish to export or import nuclear material or equipment requiring specific authorization. A multipurpose export license application NRC form 7 was developed for use with respect to the export of most different types of nuclear-material and equipment under NRC's authority. It was designed to provide the minimum amount of information necessary to allow NRC to fulfill the statutory and regulatory requirements governing nuclear-related exports. The form is clear, concise, easy to understand and simple to prepare.

2. Agency Use of Information. The Commission and the Executive Branch review the license applications submitted on NRC form 7 to make required export licensing determinations to ensure compliance with regulations. If i: applicable statutory, regulatory, and policy considerations are satisfied, I the NRC will issue ~a license authorizing the export.

l 3. Reduction of Burden through Infonnation Technology. There are no legal obstacles to reducing the burden associated with this infonnation collection. Licensees and apolicants may utilize technology if they so desire.

4. Effort to Identify Duplication. The Federal Information Locator System was searched to determine NRC and other Federal agency duplication. None was found.
5. Effort to Use Similar Information. None.

6.- Effort to Reduce Small Business Burden. The requirements specified in Sections 110.30-31 are the same for large and small businesses, because the proliferation concerns are the same. Therefore, all businesses must provide the same data, i

7. ' Consequences of Less Frequent Collection. The information referred to in Sections 110.30-31 with respect to exports is submitted whenever deemed necessary by exporters. No schedules are imposed.
8. Circumstances which Justify Variation from OMB Guidelines. None.
9. Consultations Outside the NRC. No consultations have been held with other Federal, State or local government agencies or with other persons regarding the collections of information since the submission of the last clearance.
10. Confidentiality of Information. Normally none for the information referred to in Sections 110.30-31; however, when the exporter specifically requests the NRC to keep the information confidential, the NRC will treat the information as " Company Proprietary."
11. Justification for. Sensitive Questions. There are no sensitive questions.
12. -Estimated Annualized Cost to the Federal Government. The collection of infomation under 10 CFR Part 110 Sections 110.30-31 (NRC-7 forms) require approximately 6,520 NRC professional staff hours per year to investigate, review, and take action on the license applications and to process subsequent actions with regard to issued licenses. Annual labor cost to the Federal Government at $60 per staff hour is $391,200 (6,520 hours0.00602 days <br />0.144 hours <br />8.597884e-4 weeks <br />1.9786e-4 months <br /> x

$60). (This estimate covers only the infomation collection costs associated with NRC Form 7. See OMB approval No. 3150-0036 for costs associated with other requirements under 10 CFR Part 110.)

Additional costs for information-storage, coding, tabulatory, and responding to public inquiries is approximately $90,000 per year (1,500 hrs x $60). The total annual cost to the Federal Government is approximately

$481,200.

13. Estimate of Burden. All licensees comply equally with the requirements of Sections 110.30-31. Experience has shown that an estimated 140 applications will be filed on NRC Form 7 annually. 14. Reasons for Change in Burden. We adjusted the industry burden estimate as a result of recent revisions to 10 CFR Part 110. These amendments have significantly reduced the number of persons required to complete NRC 7 foms. Many exporters may now export NRC-licensed material and equipment under the provisions of expanded general licenses; therefore, NRC-7 foms are not required.
