SUMMARY

OF THE REACTOR OVERSIGHT PROCESS MONTHLY PUBLIC MEETING HELD ON JULY 28, 2021 On July 28, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public meeting with the Nuclear Energy Institutes (NEIs) Reactor Oversight Process (ROP) Task Force executives, and other senior industry executives, to discuss the staffs progress on the ROP initiatives. The topics discussed during this teleconference are described below.

Working Group Recommendations for Inspection Procedure 37060, 10 CFR 50.69 Risk-Informed Categorization and Treatment Inspection, Enhancement The NRC staff provided an update on their recommendations to revise Inspection Procedure 37060, 10 CFR 50.69 Risk-Informed Categorization and Treatment of Structures, Systems, and Components Inspection. NEI asked clarifying questions to determine if new inspector guidance would be created or if the staff would be leveraging existing guidance. The staff responded that existing guidance would be incorporated by reference into the inspection procedure.

Additionally, NEI presented their proposal for NEI 21-05, Risk-informed Reporting Guidance.

NEI stated that reportability guidance, including 10 CFR 50.69 reportability, should be incorporated into NUREG -1022 and offered NEI 21-05 as a method for incorporation. NEI stated that they would like to engage NRC staff to review and ultimately provide for licensees to use. NEI proposed that the ROP Task Force is the right forum to engage the NRC staff in dialog during the staffs review. However, NEI stated that they have not decided if they will request NRC staff endorsement.

A. Masters Whitepaper on the Emergency Response Facility and Equipment Readiness (ERFER)

Performance Indicator (PI)

NEI presented a Whitepaper that proposes to replace the Alert and Notification System PI with an ERFER PI ((Agencywide Document Access Management System (ADAMS) Accession No. ML212208A021). NEI indicated that the proposed change is driven by the growing number of sites replacing their offsite siren system with the Integrated Public Alert and Warning System as the primary method to accomplish prompt public alerting during a radiological emergency.

NEIs anticipated path forward to implement this ERFER PI includes these actions:

(1) Gain alignment between the industry and the NRC on the ERFER PI described in the White Paper.

(2) NEI to submit a ROP whitepaper/FAQ to formally seek the necessary change to NEI 99-02.

(3) Public meeting engagement to agree on the resolution of the ROP whitepaper/FAQ, including an implementation schedule; and (4) NRC and INPO to modify their data systems to accommodate the new ERFER PI.

Status of ANS-PI during the processing of ERFER PI FAQ 21-03 Rev 1 The NRC staff supported the presentation of NEI Whitepaper Proposal to Replace the ANS PI with an ERFER PI, and Revision 1 to FAQ 21-03 (ADAMS Accession No. Ml21207A028). The staff recommended making the FAQ final (tentative) as an interim measure pending resolution of the associated Whitepaper.

Status on Revision to Inspection Manual Chapter 0609, Appendix D Th NRC staff provided a status update regarding the efforts to revise the Public Radiation Safety Significance Determination Process (SDP) documents: 1) Inspection Manual Chapter (IMC) 0609, Appendix D, Public Radiation Safety Significance Determination Process; and 2)

IMC 0308, Attachment 3, Appendix D, Technical Basis for Public Radiation Safety Significance Determination Process. The staff communicated that with this update to the Public Radiation Safety SDP and basis documents, they plan to add guidance to enable staff to disposition violations of 10 CFR Part 37, Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material, under the Reactor Oversight Process (ROP). The staff informed stakeholders that they recently communicated with the Commission via a COMSECY. The intent of the COMSECY is to request Commission approval to add guidance in the SDP and basis documents for dispositioning 10 CFR Part 37 issues. In addition, the COMSECY would also be used to notify the Commission of the proposed SDP and basis document updates for the inclusion of additional guidance for dispositioning transportation related issues. The staff informed stakeholders that COMSECY communications with the Commission are typically not made public until after the Commission provides the staff with direction in response to the COMSECY. The staff plans to provide further updates on the SDP revision once they receive direction from the Commission.

Communicating with the NRC staff At the start of all ROP public meetings, the project manager provides contact information for the public to use to provide their name as a participant in the meeting. This contact information is also provided for submitting questions and comments to the NRC technical staff. Please note that any questions and/or comments pertaining to the ROP project can be sent to Tekia.Govan@nrc.gov. Questions and/or comments will be forward to the appropriate NRC staff. The staff also mentioned the role out of the Contact Us about ROP page on the new ROP website, which can also be used to submit questions and comments regarding the ROP initiative (https://www.nrc.gov/reactors/operating/oversight/contactus.html).

Conclusion At the end of the meeting, NRC and industry management gave closing remarks. NEI expressed appreciation for the open dialogue and willingness of NRC staff to hear industry views. The NRC management stressed the importance of the NRC being focused on providing reasonable assurance of public health and safety when considering changes to the ROP.
