COMMENTS ON PROPOSED RULES PROPOSING RESOLUTION OF THE ISSUE OF MATEPIAL FALSE STATEMENTS (SECV-86-384) The Division of Rules and Records (DRR) routinely receives and reviews } Commission Papers that discuss praposed or final rules. Our comments on SECY-86-384, which discusses the two alternative rules on providing information ' to the Coicission, follow. The statements in these rules that reflect compliance with statutes, NRC regulations, or Office of the Federal Register requirements for publication require some minor changes that you may wish to make before submitting the approved rule to DRR for publication. First, a clearance package for information collection requirements must be submitted to the Office of Management and Budget (OMB) for approval prior to submitting a proposec rule to the Office of the Federal Register for publication. Therefore, the statement on page 18 of both enclosed rules should read "has been" rather than "will be." You should consult Brenda Shelton, Chief, Records Management Branch, Office of Information and Resource Management, regarding the preparation of the information collectien clearance package. Second, the HRC published Size Standards in 1985, which we now reference in the Regulatory Flexibility Statement as shown on page 20 of Enclosure B and page 19 of Enclosure C. Finally, DRR notes that you inadvertently used the Subject Terms for 10 CFR Part 31 for 10 CFR Part 30. We have provided the correct terms for Part 30 and also have added the latest approved terms for the other parts being amended in these rules. The NRC recer.tly received a petition for rulemaking from Quality Technology Company asking that the NRC require licensees to establish Employee Concerns Programs, which would, according to the petitioner, provide a vehicle for ensuring that all information unearthed by an employee in a nuclear facility be evalqated by the NRC. This petition was docketed as PRM-50 47 and was published on Jahyary 12, 1987 s'52 FR 1200). While reading the discussion on page 13 of N

Enclosure B and pages 13'and la of Enclosure C, it occurred to us that the petitioner's concern about the disposition of safety information identified by a licensee's employee is somewhat related to the requirements in these rules. A copy of PRM-50 47, for which Stan Turel in the Office of Regulatory Research is the contact. is enclosed for your information.

Although DRR agrees that a licensee is responsible for evaluating and reporting information that it thinks affects safety, the criteria for establishing that the information is "significant" seems loose. As this discussion is written on page 13 of Enclosure B and page 15 of Enclosure C, one (playing the devil's advo. cate) could argue that if the problem could be handled under the Commis-sion's authority to modify, suspend, or revoke a license, perhaps the require. ment to notify the Commission is unnecessary.
