Dear Ms. Garde:

This is in response to your letter dated January 13, 1987, in which you appealed Mr. Donnie H. Grimsley's letter dated December 10, 1986, which denied 165 documents subject to your Freedom of Information Act (F0IA) request for documents relating to NRC's Interim Policy on Management of Allegations - Proposed NRC Manual Chapter 0517 " Management of Allegations." This response will address 120 documents identified on Appendix E of Mr. Grimsley's letter dated December 10, 1986. Mr. Chilk will responc concerning the remaining 45 documents identified on Appendix E at numbers 7, 10, 20, 21, 27, 30, 33, 35, 47, 57, 71, 77, 82, 83, 84, 86, 87, 90, 91, 97, 100, 102, 107, 109, 110, 125, 131, 132, 133, 136, 141, 142, 143, 146, 149, 153, 155, 156, 157, 158, 159, 168, 169, 183, 185.

Acting on your appeal,'I have carefully reviewed the record in this case and have determined that the 120 documents will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C.

552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. Your appeal is, therefore, denied.

The documents are drafts, comments on drafts, and internal documents that contain the advice, opinions, and recommendations of the staff and were prepared in the course of reaching a final agency decision. Exemption (5) was intended tc permit the agency's withholding of such documents to preserve the free and candid internal dialogue necessary for the careful formulation of agency decisions.

This is a final agency action on the 120 documents. As set forth in the F0IA (5 U.S.C. 552(a)(4)(B)), judicial review is available in a district court of the United States in the district in which you reside, have your principal place of business, or in the District of Columbia.
