i Commissioner Dieus' Comments on SECY-98.011 I approve staff's approach of monitoring the Agreement State implementation of the closure of these sites and collecting information on the costs to the Agreement States.

I also approve staff's consultation with the Agreernent States on funding mechanisms. 1 The staff should present the Commission with recommendations after the information is gathered and assessed and the consultation is completed.

I favor staff's proposed schedule of gathering information from the Agreement States by January 1999. It is important that any requests for Federal funding be based on  !

J estimates derived from a careful evaluation by the Agreement States. Although I believe that this schedule is realistic, I am concerned that any delay may jeopardize an NRC appropriation request for FY 2001, if needed. In support of this schedule, the Office of Nuclear Material Safety and Safeguards (NMSS) and the Regions should coordinate their efforts to ensure that the Oak Ridge National Laboratory (ORNL) reviews are completed by March 1998 and that the ORNL files are transferred to the appropriate Agreement States in a timely manner soon after. It is important that the Agreement States are provided with a complete set of the ORNL files and given adequate time for review. After the ORNL files have been transferred to the Agreement States, the States should be notified that the transfers are complete and that cost estimate information is needed by January 1999. In its notification, the staff should clearly identify what information is requested and remind the States of the benefits of providing the NRC with requested information. The staff should reiterate that the Agreement States have the responsibility to ensure that these sites are cleaned up.

As requested in the Novemoer 7,1997 Staff Requirements memorandum, the staff should notify the Commission of any difficulties experienced by NRC or the Agreement  !

States in attempting to require further remediation of these sites.
